一、项目介绍
开化 (略) 有限公司(以下简称“业主”)已经从法国开发署获得一笔外国政府贷款, (略) 分资金拟用于“法开署贷款浙江开化钱江源头保护与美丽城镇互促发展示范项目”下“第二包:生态技术服务”。
本咨询服务包括生态技术服务。
业主在此邀请申请人就上述服务内容的描述表达参与意向。

二、项目背景
开化钱江源头保护和城镇可持续发展项目(以下简称本项目),项目位于浙江省开化县。
开化县的面积为2236平方公里。该区有 点击查看>> 万人口,是经济繁荣的浙江省内一个相对落后的地区。尽管该县的地形比较崎岖,但从主要的周边城市仍可到达。然而,尽管该区拥有重要的资产,如与大自然的接触和最近创建的钱江源国家公园,但由于缺乏战略、组织和适当的设施,旅游产业缺乏竞争力。
该区的行政边界与马金溪及其支流的地理环境相吻合,构成了钱江源 (略) 分。森林生态系统覆盖了 点击查看>> %的领土,其中一半被亚热带原始森林占据。马金溪塑造了开化的历史和文化特征。开化县的水力系统和森林,特别是钱江源国家公园,为整个下游人口提供了重要的生态系统服务,特别是饮用水供应和水流调节,也是自然和资源区。
开化县属于亚热带湿润气候(年降雨量1850毫米),夏季降水高度集中。就中国全境而言,气候变化是可以明显感觉到的,气温每10年上升0.33℃。即将在开化县上游修建的开化水库将降低马金溪的洪水强度和居民区的洪水风险。
整体来看,开化县的生态系统受到不同类型的压力,这些压力直接影响到它们的完整性和生物多样性:
1. 目前仍有16个废弃的矿井和902个矿坑,这些矿坑可能通过酸性排水产生慢性金属污染。
2. 马金溪的生态连续性被一 (略) 破坏,这些堰坝阻碍了鱼类的迁移,破坏了沉积物的转运。然而,即将在上游建造的开化水库大坝,旨在确保开化的饮用水供应,将对低水流量产生积极影响。
3. 一些 (略) 理的污水直接排入河流。
4. 一小半的森林是人工的,在开发中,往往是单一的,有卫生问题。它们构成了维护天然森林生态走廊的障碍,而天然森林生态走廊对于保护某些关键物种的种群是必要的。
钱江源国家公园试点区是2017年在中国建立的十个试点国家公园之一。它占地252平方公里,年度预算约为2000万欧元,这使它能够开展雄心勃勃的计划,以提高对自然遗产(包括两个旗舰物种,黑麂和白颈长尾雉)和生态系统恢复(包括拆除马金溪上的水坝)的认识,以及建设轻型游客基础设施。其自身的预算规模证明了AFD的资金是用于公园外围的补充行动的事实。
该公园由国 (略) 管理,隶属于省林业厅。其任务是保护生物多样性,而地方发展则是政府机构的责任。然而,公园的行动是与公园及其周边地区的乡镇密切协调的。中国的法规严格限制了公园内的发展可能性,大部分已经建成或计划建成的接待和环境教育机构都在公园外。与公园内或附近的16个村庄建立了伙伴关系,使公园的管理类似于法国的国家公园核心区和加入区的制度。
钱江源被指定为国家公园试点区后,对开化县的发展政策产生了很大影响。现在的战略是减少污染性工业的存在,即使这意味着牺牲GDP的增长点,以支持第三产业活动,其中生态旅游占有突出的地位。这也导致了一个新的统一和有效的治理的建立,并增强了该地区的吸引力。另一方面,由于保护规则限制了公园内的新发展,导致发展战略以周边地区为基础。
在这种情况下,开化县希望发展其资产,创造一个原始的旅游目的地,基于对领土及其居民的发现,环境教育和生态旅游活动。该区采取的战略是通过在公园外开发的游客网络来提高国家公园的质量和形象,确认将公园的优秀环境“渗透”到整个地区的愿望,从山区到山谷、村庄,最后是开化全域。
总体目标:以生态系统服务功能的恢复、“自然化”解决方案为手段;以环境教育和生态可持续发展为抓手,最终实现国家公园与开化县的互促发展。
该项目有两个发展子目标:
生态分目标:以钱江源国家公园为原点,将生物多样性保护和适应气候变化战略拓展到全域 点击查看>> 地和水生生态系统,覆盖马金溪流域及开化县域;
城镇可持续发展分目标:依托钱江源国家公园的优良环境和开化县独特的环境文化资源,促进马金溪流域的可持续发展,推动以建立国家公园品牌为基础的生态旅游经济,把开化打造成“国家公园城市”。
该项目从法国开发署获得了6500万欧元的贷款,由项目业主在2023年至2028年期间实施。该项目将通过3个板块实施。

依托钱江源国家公园的优良环境和开化县独特的环境文化资源,促进马金溪流域的可持续发展,推动以建立公园品牌为基础的生态旅游经济,把开化打造成“国家公园城市”。
第三板块:能力建设板块;
(略) 分将包括一个技术服务特派团,以支持项目的实施和 (略) 的能力。该技术服务将由多学科专家组成,其目的是 (略) 和分散技术服务的能力,涉及与项目内容直接相关的各种主题,如河流生态连续性、森林恢复和造林工程、废弃矿山恢复、环境教育、生态旅游开发、国家公园品牌开发以及更广泛的基于自然的解决方案。 (略) 需要制作并监督生态设计。技术服务还将支持项目管理办公室在项目设计、实施和运营阶段履行与法国开发署商 (略) 会承诺计划(ESCP)中要 (略) 会责任。
开化县成立了一个项目管理办公室(PMO),负责筹备和实施该项目,并 (略) 门协调。

感兴趣的申请人必须提供证明其具备履行这些服务的资格和经验的信息。为此,应提交近期的和类似服务的书面证明文件。
类似经验的判定将基于以下内容:

国外资金贷款的业绩
该顾问将提供:
长期专家,他们将参与项目的整个实施过程。
短期专家,他们将在各种活动的实施过程中被调用。
一个专门从事废弃矿 (略) , (略) 将在项目的前两年被动员起来。
专家应当具备以下条件:
拟 (略) 必须包括以下几类领域的关键专家:生态学、环境保护、生态设计、建筑设计和绿色建筑(高性能建筑)、景观管理、生态旅游、国际资助项目管理、生态多样性保护、自然资源管理、社会学、水文学、卫生学、森林管理、环境教育、通信专业、品牌管理。
业主还将在评估申请时考虑以下内容:
境内公司为独立法人实体,须提供成立不少于5年的营业执照复印件;
外国公司需提供有效营业执照或合法登记复印件,以证明其成立不少于5年(以营业执照或合法登记日期为准)。
国内企业需提供有效的ISO9001质量管理体系证书;外国公司如不适用, (略) 公章的相关资料(如资质证书、获奖证书复印件,并附上准确的中文译文)。
申请人应具备以下资格( (略) 和境外公司):

给投标人的特殊建议
关键专家的工作由项目开化县现场任务和办公室工作组成。团队关键专家成员需会使用中文和英语。国际专家必须使用英语;当地关键专家必须使用中文和英语。
请注意,感兴趣函不是征询建议书, (略) 要求的信息不需要申请人投入大工作量来准备。在该阶段,尤其不需要方法论的描述或者专家的简历。为了加快评审过程,申请文件要求不超过80页。
四、合格性标准
1、 国籍与原产地规则
自从2002年1月1日起,本项目法开署批准的贷款已经完全放开,所有国家的货物与服务均可被本项目贷款机构的贷款(但国际禁运适用的地区除外)采购,不受供应商、承包商、顾问、分包商、实施采购中 (略) 在国家的影响。根据 2001 年 4 月 20 日的经济合作与发展组织发展援助委员意见,这一决策不仅涉及“欠发达国家”,而且涉及本项目贷款机构 (略) 有其他国家。
2、 排除情形
如果自然人、法人(包 (略) 有成员或任一分包商)在提交申请、投标或授予合同之日存在以下情形,则不得向其授予合同:
(1) 破产、清算、停业、被法庭管制活动、被破产接管、重组或由任何类似程序引发的任何类似情形;
(2) 如下情形:
a. 根据在合同实施国的法庭生效判决,在过去五年内在合同采购过程或执行中犯有欺诈、腐败或任何其他罪行,但随附诚信声明提供支持信息,证明罪行与本项目贷款机构贷款的合同无关的除外;
b. 在过去五年内,欧盟或其国主管机关认定其在采购过程或履行合同期间犯有欺诈或腐败或任何其他 (略) 罚,除非其提供相关资料以及诚信声明, (略) 罚与本项目贷款机构贷款的合同无关;
c. 在过去五年内,在贷款机构的贷款合同的采购和执行中,由法庭判决、且具有判决力的欺诈或腐败或任何其他犯罪行为。
(3) 列入联合国、欧盟及/或法国的打击恐怖主义或国际和平与安全威胁的金融制裁名单;
(4) 在过去五年中,在合同履行期间,由于重大过失或长期未能履行合同义务导致的合同终止,除非(i)该合同终止被质疑,(ii)争议仍在解决过程中或尚未有最终结果指向他们;

3、 利益冲突
除了本项目贷款机构法开署批准之外,在以下情形下,自然人或法人(包 (略) 有成员或任一分包商)不具备资格,不得参与投标程序:
(1) 属于受益人控制的关系机构或控制受益人的股东,但相关利益冲突已经提请本项目贷款机构注意并得到圆满解决的除外;
(2) 与受益人参与选择程序或合同监督程序的员工存在业务或家庭关系的,但相关利益冲突已经提请本项目贷款机构注意并得到圆满解决的除外;
(3) 受其他投标人控制、控制其他投标人或者与其他投标人接受共同控制、或者直接或间接从其他投标人获取或向其授予补贴、与其他投标人拥有相同的法定代表人、与其他投标人直接或间接接触使其拥有或接触相关招标的信息、对其施加影响或影响受益人决策的;
(4) 从事的咨询活动的性质,可能与为受益人开展的任务存在冲突;
(5) 对于工程或货物的采购程序:
a. 曾经编制属于标的的规格、图纸、计算及可行性研究报告和其他文件或与编制顾问存在关系;
b. 自己或任何关联机构曾经受聘(或建议受聘)开展工程监督或合同检查。
(6) 为国有机构,但无法提供证据证明:(a) 其具有法律和财务上的自主权及/或(b) 确实根据商法经营;
(7) 参与本项 (略) 不得参与本项目下的任何投标。
4、 禁运
受益人承诺,未在受联合国、欧盟或法国禁运的领域获得、供应任何货物或从事经营。
五、联合体
申请人应以联合体名义或作为联合体的成员方提交一份意向书。子咨询顾问可以同时参与不同的投标。
意向书中应包括一份联合体协议,内容包括:
(1) 所有联合体成员方签署的联合体协议副本,或有意向执行联合体协议的函,由所有联合体成员签署并附联合体协议建议书;
(2) 联合体协议中应注明牵头方及各自拟承担的工作和责任,并承诺中标后联合体各方将向业主承担连带责任。
若联合体未提交该文件,则其他成员方将被视为子咨询顾问。在评标过程中,子咨询顾问的经验和资格不被考虑在内。
咨询服务必须由拥有丰富专业经验的中 (略) 组成的联合体共同提供,联合体成员 (略) 。
六、 投标语言
申请人准备的意向书以及申请人、业主和招标代理交换的与 (略) 有通信和文件,均应以英文书写,并附上准确的中文译文。
作 (略) 分的支持文件和印刷文献可能是另一种语言提供的,应附有准确的英文和中文翻译。
申请人需准备一(1)份英文意向书原件和一(1)份中文意向书原件。申请人还需准备一(1)份电子版意向书副本,发送到下面的邮箱。

I. Introduction
The Kaihua County Liangshan Investment Group Co., Ltd.(hereinafter referred to as "the Employer") has received a financing from Agence Fran?aise de Développement ("AFD"), and intends to use part of the funds thereof for payments under the following project Protection of Qianjiang River source and promotion of sustainable development around the city of Kaihua and Qianjiangyuan nation Park -Lot 2: Ecological Technical Assistance.
The Services of the consultant shall consist of Ecological Technical Assistance.
The Employer hereby invites Applicants to show their interest in delivering the Services described above.

II. Project Background
The “Protection of Qianjiang River source and promotion of sustainable development around the city of Kaihua and Qianjiangyuan Nation Park Project”, hereinafter referred to as "the Project" is located in Kaihua County of Zhejiang Province.
Kaihua District covers an area of 2,236 km2. With a population of 360,600, it is a relatively less developed district within the economically prosperous province of Zhejiang. Although its terrain is quite rugged, the district is still accessible from major neighboring cities. However, despite the district"s significant assets, such as its contact with nature and the recent creation of the Qianjiangyuan National Park, the tourism sector lacks competitiveness due to a lack of strategy, organization and appropriate facilities.
The administrative boundaries of the district coincide with the geography of the Majin River and its tributaries, which form part of the upper Qianjiang River watershed. The hydro-system and forests of Kaihua District, especially Qianjiangyuan National Park, provide important ecosystem services to the entire downstream population, especially for drinking water supply and water flow regulation, but also as a nature and resource area.
The Kaihua County is subject to a humid subtropical climate (1850 mm of rainfall per year), with a high concentration of precipitation in summer. As for the whole territory of China, the climate change is clearly perceptible, with a rate of temperatures increasing of 0.33°C per 10 years. The upcoming construction of a new dam upstream of the city of Kaihua will reduce the intensity of flooding of the Majin River and the risk of flooding in inhabited areas.
In general terms, the ecosystems of the Kaihua district are subject to different types of pressures, which directly affect their integrity and biodiversity.
- There are still 16 abandoned mines and 902 mining pits, which may generate chronic metal pollution through acid drainage.
- The ecological continuity of the Majin River is disrupted by a succession of weirs, which prevent fish migration and disrupt sediment transit. The imminent construction of a dam upstream, intended to secure the supply of drinking water to Kaihua, will however have positive consequences on low water flows.
- Some villages discharge their untreated effluent directly into the rivers.
- A small half of the forests are artificial, in exploitation and often mono-specific, with sanitary problems. They constitute obstacles to the maintenance of ecological corridors of natural forests, necessary for the conservation of populations of certain key species.
Qianjiangyuan National Park is one of ten pilot national parks established in China in 2017. It covers an area of 252 km2 and has an annual budget of approximately 20 million euros, which allows it to carry out ambitious programs to improve knowledge of natural heritage (including two flagship species, the black muntjack and the Eliott"s pheasant) and ecosystem restoration (including the removal of dams on the Majin River) as well as the construction of light visitor infrastructure. The size of its own budget justifies the fact that AFD funding is directed towards complementary actions on the periphery of the park.
The park is managed by the national park management office, which is part of the provincial forestry office. Its mission is to protect biodiversity, while local development is the responsibility of government institutions. However, the actions of the park are closely coordinated with the communes of the park and its peripheral zone. Chinese regulations strictly limit the possibilities of development inside the park, and most of the reception and environmental education structures that have been built or are planned are outside the park. Partnerships have been established with 16 villages within or near the park, making the governance of the park similar to the French system of national parks core area and accession areas.
The designation of Qianjiangyuan as a pilot national park has strongly influenced the development policy of the city of Kaihua. Its strategy is now to reduce the presence of polluting industries, even if it means sacrificing GDP growth points, in favour of tertiary activities, among which ecotourism holds a prominent place. It has also led to the establishment of a new unified and effective governance and has enhanced the attractiveness of the district. On the other hand, the fact that the protection rules limit new developments inside the park leads to base the development strategy on the peripheral areas.
In this context, the Kaihua district wishes to develop its assets to create an original tourist destination, based on the discovery of the territory and its inhabitants, environmental education and ecotourism activities. The strategy adopted by the district is to enhance the qualities and image of the national park through a network of visitors developed outside the park, affirming the desire to "trickle down" the environmental excellence of the park throughout the district, from the mountains to the valleys, villages and finally the city of Kaihua.
The goal of the Project is to build a development synergy between the Qianjiangyuan National Park and Kaihua County, based on the restoration of ecosystem services, environmental excellence, nature-based solutions, environmental education and sustainable economic development.
The Project has two development objectives:
- Extend biodiversity conservation and climate change adaptation strategies from Qianjiangyuan National Park to terrestrial and aquatic ecosystems and the Majin River watershed and the entire Kaihua County;
- Building on the environmental excellence of Qianjiangyuan National Park and the unique environmental and cultural resources of Kaihua County to promote sustainable development of the Majin River watershed and its tributaries and to promote the establishment of an ecotourism economy based on the Park brand and making Kaihua a "Park City".
The Project has obtained a loan of € 65 million from the French Development Agency and is to be implemented by the Project owner from 2023 to 2028. The project will be implemented through 3 components (non-exhaustive list):
Component 1: Biodiversity restoration and services provided by natural ecosystems
This component aims to i) improve the ecological continuity in the Majin River catchment area, ii) create ecological corridors at the territorial level of Kaihua, and iii) define restoration plans for the remediation of abandoned mines and the renaturation of brownfields. This strategy adopted allows for major advances in biodiversity conservation, ecosystem services (particularly in terms of climate change mitigation and adaptation) while increasing the attractiveness of the territory.
Component 2: Development of ecotourism and environmental education
This component aims to develop an ecotourism destination characterized by the quality of ecosystems, natural landscapes and the environment, the discovery of culture, know-how and local production and a high level of environmental education, based on the value of the national park.
Component 3: Capacity building and technical support
This component will include a technical assistance mission to support the implementation of the project and to strengthen the capacities of local authorities. This technical assistance will be made up of a pool of multidisciplinary experts whose aim is to strengthen the capacities of local authorities and decentralized technical services, on various themes directly related to the content of the project such as river ecological continuity, forest renaturation and afforestation, abandoned mines restoration, environmental education, ecotourism development, national park branding development and more generally, nature-based 点击查看>> team of expert may have to develop and monitor some ecologic de 点击查看>> technical assistance will also support the PMO in performing environmental and social diligences required in the environmental and social commitment plan (ESCP) agreed with AFD, all along the project design, implementation and operation phases.
Kaihua District has set up a Project Management Office (PMO) in charge of preparing and implementing the project, in coordination with the concerned departments within the District.
A technical committee, animated by the Head of PMO, will be set up by the authorities in order to discuss and validate the decisions concerning the project.
The project will be managed by the Kaihua County Liangshan Investment Group Co., Ltd.
Purposes of the assignmentTo effectively implement the project, the project owner seeks a consulting service with following tasks:
Task 1: Provide technical assistance for project management
Task 2: Social and Environmental Investigation
Task 3: Capacity building and skills training for local residents and stakeholders.
Task 4: Support for Qianjiangyuan National Park
Task 5: Technical assistance and capacity building in ecological engineering
Task 6: Diagnosis and Design of Abandoned Mine Restoration
The research scope of this project is the whole area of Kaihua County. The key projects are mainly concentrated in the main stream of Majinxi (Shizhu Village to Xiashan Village area), and the main new buildings are concentrated in the Bianshi area.
The precise contents and detailed assigment of each task will be specified at the later stage (Request for Proposals).
The consulting services will run through the project implementation period, i.e. from 2023 to 2028.
III. Evaluation Criteria
The services under this lot are to be provided by a team comprising of international and local consultants with rich experience in the related field.
General expertise requirements for the Consultant are presented below. Detailed expertise requirements will be presented at the next phase (Request for Proposals).
Consultant
Services are to be provided by a team of Chinese and International consulting firms. The team must have:
Demonstrated experience in environmental protection, ecotourism, biodiversity restoration, environmental education, technical support
Demonstrated experience in supporting the implementation of internationally financed projects in China.
Interested consultants must provide information evidencing that they are qualified and experienced to perform those Services. For that purpose, documented evidence of recent and similar services shall be submitted.
Determination of the similarity of the experiences will be based on:
- The contracts size;
- The nature of the Services (Ecological Technical Assistance);
- The technical area and expertise (environmental protection, ecotourism, biodiversity restoration, environmental education, technical support);
- Experience in the Client’s country(PRC)
- Experience in internationally funded projects
The consultant will provide:
long-term experts who will be involved throughout the implementation of the project,
short-term experts who will be called upon as the various activities are implemented,
a team specialized in abandoned mine remediation, which will be mobilized during the first two years of the project;
Experts
The proposed Project team must include key experts with competencies in the following fields: ecology, environment protection, ecology design, architecture design and green building (high-energy performance building), landscape management, ecotourism, internationally funded project management, biodiversity conservation, natural resources management, sociology, hydrology, sanitation, forest management, environmental education, communication, brand management.
The Client will also take into account for the evaluation of the applications the following items:
- Domestic companies shall be independent legal entities and must provide copies of business license which shows they have been established for no less than 5 years;
- Foreign companies shall provide either valid business licenses or a copies of legal registration, as evidence that they have been established for no less than 5 years (the date on business license or legal registration shall prevail).
-Domestic companies shall provide valid ISO9001 Quality Management System Certificate; foreign companies shall present related documentation with official company seal (such as qualification certificates and copy of award certificates accompanied by accurate Chinese translation) if the said certificate is not applicable.
Applicants (International and national) shall have the following qualifications
1. Corresponding Class B qualification for forestry survey, planning and design or equivalent
2. Corresponding Class B qualification for hydraulic and hydroelectric engineering design or equivalent
3. Corresponding Class A qualification for geological disaster control engineering design or environmental protection engineering professional contracting or ecological construction and environmental engineering consulting (“Pollution Remediation Engineering”) or equivalent
4. Corresponding Class A qualification for landscape and ecology design or equivalent
Specific recommendations for the bidders
The assignment of the key experts is comprised by in-house and on-site work.
The Bidder must have key experts who speak Chinese and English. International experts must speak English; local key experts must speak both Chinese and English.
It is noted that the Request for Expression of Interest is not a Request for Proposals, and the requested information should not involve a large amount of work from the applicants. In particular, the drafting of a methodology or the identification and submission of CVs of experts for the consulting services are not required at this stage. In order to speed up the evaluation process, it is required that the application documents do not exceed 80 pages.
IV. Eligibility Criteria to the Financing
1. Rules of nationality and of origin
Financing allocated by AFD has been entirely untied since 1st January 2002. All procurement of goods, works, plants, consulting services and non-consulting services are eligible for AFD financing regardless of the country of origin of the providers, contractors or consultants (including subcontractors, subconsultants and suppliers), except where an international embargo applies . This decision not only concerns the "Least Developed Countries" (LDCs), pursuant to the Organisation for Economic Cooperation and Development (OECD)/ Development Assistance Committee (DAC) Recommendation of 20th April 2001 on untying aid, but also all the other foreign countries where AFD operates.
2. Grounds for exclusion
A Person (including all members of a joint venture or any of their subcontractors) shall not be awarded an AFD-financed contract if, on the date of submission of an application or of a bid or a proposal or on the date of award of a contract, they:
1) Are bankrupt, being wound up or ceasing their activities, are having their activities administered by the courts, have entered into receivership, or are in any analogous situation arising from any similar procedure;
2) Have been:
a. convicted within the past five years by a court decision, which has the force of res judicata in the country where the contract is implemented, of fraud or corruption or any other offence committed during the procurement process or performance of a contract, unless they provide supporting information together with their Statement of Integrity which shows that this conviction is not relevant in the context of this AFD financed contract;
b. subject to an administrative sanction within the past five years by the European Union or the competent authorities of the country where they are constituted, for fraud or corruption or for any other offence committed during a procurement process or performance of a contract, unless they provide supporting information together with their Statement of Integrity which shows that this conviction is not relevant in the context of this AFD financed contract;
c. convicted within the past five years by court decision, which has the force of res judicata, of fraud or corruption or of any other offence committed in the context of an AFD-financed procurement process or performance of a contract;
3) Are listed for financial sanctions by the United Nations, the European Union and/or France for the purposes of fight against terrorist financing or threat to international peace and security;
4) Have been subject within the last five years to a contract termination fully settled against them for significant or persistent failure to comply with their contractual obligations during contract performance, unless (i) this termination was challenged and (ii) dispute resolution is still pending or has not confirmed a full settlement against them;
5) Have not fulfilled their fiscal obligations regarding payments of taxes in accordance with the legal provisions of either the country where they are constituted or the Beneficiary"s country;
6) Are subject to an exclusion decision of the World Bank and are listed on the website http:/ 点击查看>> , unless they provide supporting information together with their Statement of Integrity which shows that the exclusion is not relevant in the context of this AFD-financed project;
7) Have created false documents or have committed misrepresentation in documentation requested by the Beneficiary as part of the procurement process of this contract.
3. Conflict of interest
Except in cases duly accepted by AFD, a Person (including all members of a joint venture or any of their subcontractors) shall be disqualified in a competitive procurement process if they:
1) Are an affiliate controlled by the Beneficiary or a shareholder controlling the Beneficiary, unless the stemming conflict of interest has been brought to the attention of AFD and resolved to its satisfaction;
2) Have a business or a family relationship with a Beneficiary"s staff involved in the procurement process or the supervision of the resulting contract, unless the stemming conflict of interest has been brought to the attention of AFD and resolved to its satisfaction;
3) Are controlled by or control another bidder or are under common control with another bidder, receive from or grant subsidies directly or indirectly to another bidder, have the same legal representative as another bidder, maintain direct or indirect contacts with another bidder which allow them to have or give access to information contained in the respective bids, to influence them or influence the decisions of the Beneficiary;
4) Are engaged in a consulting services activity which, by its nature, may be in conflict with the assignments that they would carry out for the Beneficiary;
5) In the case of a procurement process for goods, works or plants:
i. Prepared or have been associated with a consultant who prepared specifications, drawings, calculations and other documentation for the procurement process;
ii. Have been recruited or are proposed to be recruited, themselves or any of their affiliates, to carry out works supervision or inspection for this contract.
6) Are state-owned entities, which are not able to provide evidence that (a) they are legally and financially autonomous and/or (b) they do operate under commercial law.
7) Consultants who took part in the project’s feasibility study are not entitled to submit an offer for any lot of the project.
4. Embargos
The Beneficiary undertakes not to acquire or supply any equipment or to operate in any sector which is subject to an embargo by the United Nations, the European Union or France.
V. Joint Venture
The Applicant shall submit only one application, either in its own name or as a member of a Joint Venture (JV). However, the same Subconsultant may participate in several applications.
If the Applicant is a JV, the expression of interest shall include:
1. A copy of the JV Agreement entered into by all members, or
a letter of intent to execute a JV Agreement, signed by all members together with a copy of the Agreement proposal;
2.JV Agreement shall indicate the leading partner of the JV and respective work scope and responsibility as well as a commitment to state that each party of the JV will assume liable responsibility to the Employer if they won the bid.
In the absence of this document, the other members will be considered as Sub-consultants.
Experiences and qualifications of Sub-consultants are not taken into account in the evaluation of the applications.
If the Applicant is a JV, members of the JV shall not be more than 6 (six) firms in total.
VI. Language of Bid
The EOI prepared by the Applicant and all correspondence and documents relating to the Bid exchanged by the Applicant, Employer and Tendering Agent, shall be written in English with accurate Chinese translation attached.
Supporting documents and printed literature that are part of the EOI may be in another language provided shall be accompanied by an accurate English and Chinese translation.
Applicants shall prepare ONE (1) original EOI in English and ONE(1) original EOI in Chinese.

开化县的面积为2236平方公里。该区有 点击查看>> 万人口,是经济繁荣的浙江省内一个相对落后的地区。尽管该县的地形比较崎岖,但从主要的周边城市仍可到达。然而,尽管该区拥有重要的资产,如与大自然的接触和最近创建的钱江源国家公园,但由于缺乏战略、组织和适当的设施,旅游产业缺乏竞争力。
该区的行政边界与马金溪及其支流的地理环境相吻合,构成了钱江源 (略) 分。森林生态系统覆盖了 点击查看>> %的领土,其中一半被亚热带原始森林占据。马金溪塑造了开化的历史和文化特征。开化县的水力系统和森林,特别是钱江源国家公园,为整个下游人口提供了重要的生态系统服务,特别是饮用水供应和水流调节,也是自然和资源区。
开化县属于亚热带湿润气候(年降雨量1850毫米),夏季降水高度集中。就中国全境而言,气候变化是可以明显感觉到的,气温每10年上升0.33℃。即将在开化县上游修建的开化水库将降低马金溪的洪水强度和居民区的洪水风险。
整体来看,开化县的生态系统受到不同类型的压力,这些压力直接影响到它们的完整性和生物多样性:
1. 目前仍有16个废弃的矿井和902个矿坑,这些矿坑可能通过酸性排水产生慢性金属污染。
2. 马金溪的生态连续性被一 (略) 破坏,这些堰坝阻碍了鱼类的迁移,破坏了沉积物的转运。然而,即将在上游建造的开化水库大坝,旨在确保开化的饮用水供应,将对低水流量产生积极影响。
3. 一些 (略) 理的污水直接排入河流。
4. 一小半的森林是人工的,在开发中,往往是单一的,有卫生问题。它们构成了维护天然森林生态走廊的障碍,而天然森林生态走廊对于保护某些关键物种的种群是必要的。
钱江源国家公园试点区是2017年在中国建立的十个试点国家公园之一。它占地252平方公里,年度预算约为2000万欧元,这使它能够开展雄心勃勃的计划,以提高对自然遗产(包括两个旗舰物种,黑麂和白颈长尾雉)和生态系统恢复(包括拆除马金溪上的水坝)的认识,以及建设轻型游客基础设施。其自身的预算规模证明了AFD的资金是用于公园外围的补充行动的事实。
该公园由国 (略) 管理,隶属于省林业厅。其任务是保护生物多样性,而地方发展则是政府机构的责任。然而,公园的行动是与公园及其周边地区的乡镇密切协调的。中国的法规严格限制了公园内的发展可能性,大部分已经建成或计划建成的接待和环境教育机构都在公园外。与公园内或附近的16个村庄建立了伙伴关系,使公园的管理类似于法国的国家公园核心区和加入区的制度。
钱江源被指定为国家公园试点区后,对开化县的发展政策产生了很大影响。现在的战略是减少污染性工业的存在,即使这意味着牺牲GDP的增长点,以支持第三产业活动,其中生态旅游占有突出的地位。这也导致了一个新的统一和有效的治理的建立,并增强了该地区的吸引力。另一方面,由于保护规则限制了公园内的新发展,导致发展战略以周边地区为基础。
在这种情况下,开化县希望发展其资产,创造一个原始的旅游目的地,基于对领土及其居民的发现,环境教育和生态旅游活动。该区采取的战略是通过在公园外开发的游客网络来提高国家公园的质量和形象,确认将公园的优秀环境“渗透”到整个地区的愿望,从山区到山谷、村庄,最后是开化全域。
总体目标:以生态系统服务功能的恢复、“自然化”解决方案为手段;以环境教育和生态可持续发展为抓手,最终实现国家公园与开化县的互促发展。
该项目有两个发展子目标:
生态分目标:以钱江源国家公园为原点,将生物多样性保护和适应气候变化战略拓展到全域 点击查看>> 地和水生生态系统,覆盖马金溪流域及开化县域;
城镇可持续发展分目标:依托钱江源国家公园的优良环境和开化县独特的环境文化资源,促进马金溪流域的可持续发展,推动以建立国家公园品牌为基础的生态旅游经济,把开化打造成“国家公园城市”。
该项目从法国开发署获得了6500万欧元的贷款,由项目业主在2023年至2028年期间实施。该项目将通过3个板块实施。

专家应当具备以下条件:

业主还将在评估申请时考虑以下内容:
境内公司为独立法人实体,须提供成立不少于5年的营业执照复印件;
外国公司需提供有效营业执照或合法登记复印件,以证明其成立不少于5年(以营业执照或合法登记日期为准)。

关键专家的工作由项目开化县现场任务和办公室工作组成。团队关键专家成员需会使用中文和英语。国际专家必须使用英语;当地关键专家必须使用中文和英语。
请注意,感兴趣函不是征询建议书, (略) 要求的信息不需要申请人投入大工作量来准备。在该阶段,尤其不需要方法论的描述或者专家的简历。为了加快评审过程,申请文件要求不超过80页。
四、合格性标准
1、 国籍与原产地规则
自从2002年1月1日起,本项目法开署批准的贷款已经完全放开,所有国家的货物与服务均可被本项目贷款机构的贷款(但国际禁运适用的地区除外)采购,不受供应商、承包商、顾问、分包商、实施采购中 (略) 在国家的影响。根据 2001 年 4 月 20 日的经济合作与发展组织发展援助委员意见,这一决策不仅涉及“欠发达国家”,而且涉及本项目贷款机构 (略) 有其他国家。
2、 排除情形
如果自然人、法人(包 (略) 有成员或任一分包商)在提交申请、投标或授予合同之日存在以下情形,则不得向其授予合同:
(1) 破产、清算、停业、被法庭管制活动、被破产接管、重组或由任何类似程序引发的任何类似情形;
(2) 如下情形:
a. 根据在合同实施国的法庭生效判决,在过去五年内在合同采购过程或执行中犯有欺诈、腐败或任何其他罪行,但随附诚信声明提供支持信息,证明罪行与本项目贷款机构贷款的合同无关的除外;
b. 在过去五年内,欧盟或其国主管机关认定其在采购过程或履行合同期间犯有欺诈或腐败或任何其他 (略) 罚,除非其提供相关资料以及诚信声明, (略) 罚与本项目贷款机构贷款的合同无关;
c. 在过去五年内,在贷款机构的贷款合同的采购和执行中,由法庭判决、且具有判决力的欺诈或腐败或任何其他犯罪行为。
(3) 列入联合国、欧盟及/或法国的打击恐怖主义或国际和平与安全威胁的金融制裁名单;
(4) 在过去五年中,在合同履行期间,由于重大过失或长期未能履行合同义务导致的合同终止,除非(i)该合同终止被质疑,(ii)争议仍在解决过程中或尚未有最终结果指向他们;

3、 利益冲突
除了本项目贷款机构法开署批准之外,在以下情形下,自然人或法人(包 (略) 有成员或任一分包商)不具备资格,不得参与投标程序:
(1) 属于受益人控制的关系机构或控制受益人的股东,但相关利益冲突已经提请本项目贷款机构注意并得到圆满解决的除外;
(2) 与受益人参与选择程序或合同监督程序的员工存在业务或家庭关系的,但相关利益冲突已经提请本项目贷款机构注意并得到圆满解决的除外;
(3) 受其他投标人控制、控制其他投标人或者与其他投标人接受共同控制、或者直接或间接从其他投标人获取或向其授予补贴、与其他投标人拥有相同的法定代表人、与其他投标人直接或间接接触使其拥有或接触相关招标的信息、对其施加影响或影响受益人决策的;
(4) 从事的咨询活动的性质,可能与为受益人开展的任务存在冲突;
(5) 对于工程或货物的采购程序:
a. 曾经编制属于标的的规格、图纸、计算及可行性研究报告和其他文件或与编制顾问存在关系;
b. 自己或任何关联机构曾经受聘(或建议受聘)开展工程监督或合同检查。
(6) 为国有机构,但无法提供证据证明:(a) 其具有法律和财务上的自主权及/或(b) 确实根据商法经营;
(7) 参与本项 (略) 不得参与本项目下的任何投标。
4、 禁运
受益人承诺,未在受联合国、欧盟或法国禁运的领域获得、供应任何货物或从事经营。
五、联合体
申请人应以联合体名义或作为联合体的成员方提交一份意向书。子咨询顾问可以同时参与不同的投标。
意向书中应包括一份联合体协议,内容包括:
(1) 所有联合体成员方签署的联合体协议副本,或有意向执行联合体协议的函,由所有联合体成员签署并附联合体协议建议书;
(2) 联合体协议中应注明牵头方及各自拟承担的工作和责任,并承诺中标后联合体各方将向业主承担连带责任。
若联合体未提交该文件,则其他成员方将被视为子咨询顾问。在评标过程中,子咨询顾问的经验和资格不被考虑在内。
咨询服务必须由拥有丰富专业经验的中 (略) 组成的联合体共同提供,联合体成员 (略) 。
六、 投标语言

I. Introduction
The Kaihua County Liangshan Investment Group Co., Ltd.(hereinafter referred to as "the Employer") has received a financing from Agence Fran?aise de Développement ("AFD"), and intends to use part of the funds thereof for payments under the following project Protection of Qianjiang River source and promotion of sustainable development around the city of Kaihua and Qianjiangyuan nation Park -Lot 2: Ecological Technical Assistance.
The Services of the consultant shall consist of Ecological Technical Assistance.
The Employer hereby invites Applicants to show their interest in delivering the Services described above.

II. Project Background
The “Protection of Qianjiang River source and promotion of sustainable development around the city of Kaihua and Qianjiangyuan Nation Park Project”, hereinafter referred to as "the Project" is located in Kaihua County of Zhejiang Province.
Kaihua District covers an area of 2,236 km2. With a population of 360,600, it is a relatively less developed district within the economically prosperous province of Zhejiang. Although its terrain is quite rugged, the district is still accessible from major neighboring cities. However, despite the district"s significant assets, such as its contact with nature and the recent creation of the Qianjiangyuan National Park, the tourism sector lacks competitiveness due to a lack of strategy, organization and appropriate facilities.
The administrative boundaries of the district coincide with the geography of the Majin River and its tributaries, which form part of the upper Qianjiang River watershed. Forest ecosystems cover 点击查看>> % of the territory, half of which is occupied by primary subtropical forests. The Majin River has shaped Kaihua"s history and cultural identity. The hydro-system and forests of Kaihua District, especially Qianjiangyuan National Park, provide important ecosystem services to the entire downstream population, especially for drinking water supply and water flow regulation, but also as a nature and resource area.
The Kaihua County is subject to a humid subtropical climate (1850 mm of rainfall per year), with a high concentration of precipitation in summer. As for the whole territory of China, the climate change is clearly perceptible, with a rate of temperatures increasing of 0.33°C per 10 years. The upcoming construction of a new dam upstream of the city of Kaihua will reduce the intensity of flooding of the Majin River and the risk of flooding in inhabited areas.
In general terms, the ecosystems of the Kaihua district are subject to different types of pressures, which directly affect their integrity and biodiversity.
- There are still 16 abandoned mines and 902 mining pits, which may generate chronic metal pollution through acid drainage.
- The ecological continuity of the Majin River is disrupted by a succession of weirs, which prevent fish migration and disrupt sediment transit. The imminent construction of a dam upstream, intended to secure the supply of drinking water to Kaihua, will however have positive consequences on low water flows.
- Some villages discharge their untreated effluent directly into the rivers.
- A small half of the forests are artificial, in exploitation and often mono-specific, with sanitary problems. They constitute obstacles to the maintenance of ecological corridors of natural forests, necessary for the conservation of populations of certain key species.
Qianjiangyuan National Park is one of ten pilot national parks established in China in 2017. It covers an area of 252 km2 and has an annual budget of approximately 20 million euros, which allows it to carry out ambitious programs to improve knowledge of natural heritage (including two flagship species, the black muntjack and the Eliott"s pheasant) and ecosystem restoration (including the removal of dams on the Majin River) as well as the construction of light visitor infrastructure. The size of its own budget justifies the fact that AFD funding is directed towards complementary actions on the periphery of the park.
The park is managed by the national park management office, which is part of the provincial forestry office. Its mission is to protect biodiversity, while local development is the responsibility of government institutions. However, the actions of the park are closely coordinated with the communes of the park and its peripheral zone. Chinese regulations strictly limit the possibilities of development inside the park, and most of the reception and environmental education structures that have been built or are planned are outside the park. Partnerships have been established with 16 villages within or near the park, making the governance of the park similar to the French system of national parks core area and accession areas.
The designation of Qianjiangyuan as a pilot national park has strongly influenced the development policy of the city of Kaihua. Its strategy is now to reduce the presence of polluting industries, even if it means sacrificing GDP growth points, in favour of tertiary activities, among which ecotourism holds a prominent place. It has also led to the establishment of a new unified and effective governance and has enhanced the attractiveness of the district. On the other hand, the fact that the protection rules limit new developments inside the park leads to base the development strategy on the peripheral areas.
In this context, the Kaihua district wishes to develop its assets to create an original tourist destination, based on the discovery of the territory and its inhabitants, environmental education and ecotourism activities. The strategy adopted by the district is to enhance the qualities and image of the national park through a network of visitors developed outside the park, affirming the desire to "trickle down" the environmental excellence of the park throughout the district, from the mountains to the valleys, villages and finally the city of Kaihua.
The goal of the Project is to build a development synergy between the Qianjiangyuan National Park and Kaihua County, based on the restoration of ecosystem services, environmental excellence, nature-based solutions, environmental education and sustainable economic development.
The Project has two development objectives:
- Extend biodiversity conservation and climate change adaptation strategies from Qianjiangyuan National Park to terrestrial and aquatic ecosystems and the Majin River watershed and the entire Kaihua County;
- Building on the environmental excellence of Qianjiangyuan National Park and the unique environmental and cultural resources of Kaihua County to promote sustainable development of the Majin River watershed and its tributaries and to promote the establishment of an ecotourism economy based on the Park brand and making Kaihua a "Park City".
The Project has obtained a loan of € 65 million from the French Development Agency and is to be implemented by the Project owner from 2023 to 2028. The project will be implemented through 3 components (non-exhaustive list):
Component 1: Biodiversity restoration and services provided by natural ecosystems
This component aims to i) improve the ecological continuity in the Majin River catchment area, ii) create ecological corridors at the territorial level of Kaihua, and iii) define restoration plans for the remediation of abandoned mines and the renaturation of brownfields. This strategy adopted allows for major advances in biodiversity conservation, ecosystem services (particularly in terms of climate change mitigation and adaptation) while increasing the attractiveness of the territory.
Component 2: Development of ecotourism and environmental education
This component aims to develop an ecotourism destination characterized by the quality of ecosystems, natural landscapes and the environment, the discovery of culture, know-how and local production and a high level of environmental education, based on the value of the national park.
Component 3: Capacity building and technical support
This component will include a technical assistance mission to support the implementation of the project and to strengthen the capacities of local authorities. This technical assistance will be made up of a pool of multidisciplinary experts whose aim is to strengthen the capacities of local authorities and decentralized technical services, on various themes directly related to the content of the project such as river ecological continuity, forest renaturation and afforestation, abandoned mines restoration, environmental education, ecotourism development, national park branding development and more generally, nature-based 点击查看>> team of expert may have to develop and monitor some ecologic de 点击查看>> technical assistance will also support the PMO in performing environmental and social diligences required in the environmental and social commitment plan (ESCP) agreed with AFD, all along the project design, implementation and operation phases.
Kaihua District has set up a Project Management Office (PMO) in charge of preparing and implementing the project, in coordination with the concerned departments within the District.
A technical committee, animated by the Head of PMO, will be set up by the authorities in order to discuss and validate the decisions concerning the project.
The project will be managed by the Kaihua County Liangshan Investment Group Co., Ltd.
Purposes of the assignmentTo effectively implement the project, the project owner seeks a consulting service with following tasks:
Task 1: Provide technical assistance for project management
Task 2: Social and Environmental Investigation
Task 3: Capacity building and skills training for local residents and stakeholders.
Task 4: Support for Qianjiangyuan National Park
Task 5: Technical assistance and capacity building in ecological engineering
Task 6: Diagnosis and Design of Abandoned Mine Restoration
The research scope of this project is the whole area of Kaihua County. The key projects are mainly concentrated in the main stream of Majinxi (Shizhu Village to Xiashan Village area), and the main new buildings are concentrated in the Bianshi area.
The precise contents and detailed assigment of each task will be specified at the later stage (Request for Proposals).
The consulting services will run through the project implementation period, i.e. from 2023 to 2028.
III. Evaluation Criteria
The services under this lot are to be provided by a team comprising of international and local consultants with rich experience in the related field.
General expertise requirements for the Consultant are presented below. Detailed expertise requirements will be presented at the next phase (Request for Proposals).
Consultant
Services are to be provided by a team of Chinese and International consulting firms. The team must have:
Demonstrated experience in environmental protection, ecotourism, biodiversity restoration, environmental education, technical support
Demonstrated experience in supporting the implementation of internationally financed projects in China.
Interested consultants must provide information evidencing that they are qualified and experienced to perform those Services. For that purpose, documented evidence of recent and similar services shall be submitted.
Determination of the similarity of the experiences will be based on:
- The contracts size;
- The nature of the Services (Ecological Technical Assistance);
- The technical area and expertise (environmental protection, ecotourism, biodiversity restoration, environmental education, technical support);
- Experience in the Client’s country(PRC)
- Experience in internationally funded projects
The consultant will provide:
long-term experts who will be involved throughout the implementation of the project,
short-term experts who will be called upon as the various activities are implemented,
a team specialized in abandoned mine remediation, which will be mobilized during the first two years of the project;
Experts
The proposed Project team must include key experts with competencies in the following fields: ecology, environment protection, ecology design, architecture design and green building (high-energy performance building), landscape management, ecotourism, internationally funded project management, biodiversity conservation, natural resources management, sociology, hydrology, sanitation, forest management, environmental education, communication, brand management.
The Client will also take into account for the evaluation of the applications the following items:
- Domestic companies shall be independent legal entities and must provide copies of business license which shows they have been established for no less than 5 years;
- Foreign companies shall provide either valid business licenses or a copies of legal registration, as evidence that they have been established for no less than 5 years (the date on business license or legal registration shall prevail).
-Domestic companies shall provide valid ISO9001 Quality Management System Certificate; foreign companies shall present related documentation with official company seal (such as qualification certificates and copy of award certificates accompanied by accurate Chinese translation) if the said certificate is not applicable.
Applicants (International and national) shall have the following qualifications
1. Corresponding Class B qualification for forestry survey, planning and design or equivalent
2. Corresponding Class B qualification for hydraulic and hydroelectric engineering design or equivalent
3. Corresponding Class A qualification for geological disaster control engineering design or environmental protection engineering professional contracting or ecological construction and environmental engineering consulting (“Pollution Remediation Engineering”) or equivalent
4. Corresponding Class A qualification for landscape and ecology design or equivalent
Specific recommendations for the bidders
The assignment of the key experts is comprised by in-house and on-site work.
The Bidder must have key experts who speak Chinese and English. International experts must speak English; local key experts must speak both Chinese and English.
It is noted that the Request for Expression of Interest is not a Request for Proposals, and the requested information should not involve a large amount of work from the applicants. In particular, the drafting of a methodology or the identification and submission of CVs of experts for the consulting services are not required at this stage. In order to speed up the evaluation process, it is required that the application documents do not exceed 80 pages.
IV. Eligibility Criteria to the Financing
1. Rules of nationality and of origin
Financing allocated by AFD has been entirely untied since 1st January 2002. All procurement of goods, works, plants, consulting services and non-consulting services are eligible for AFD financing regardless of the country of origin of the providers, contractors or consultants (including subcontractors, subconsultants and suppliers), except where an international embargo applies . This decision not only concerns the "Least Developed Countries" (LDCs), pursuant to the Organisation for Economic Cooperation and Development (OECD)/ Development Assistance Committee (DAC) Recommendation of 20th April 2001 on untying aid, but also all the other foreign countries where AFD operates.
2. Grounds for exclusion
A Person (including all members of a joint venture or any of their subcontractors) shall not be awarded an AFD-financed contract if, on the date of submission of an application or of a bid or a proposal or on the date of award of a contract, they:
1) Are bankrupt, being wound up or ceasing their activities, are having their activities administered by the courts, have entered into receivership, or are in any analogous situation arising from any similar procedure;
2) Have been:
a. convicted within the past five years by a court decision, which has the force of res judicata in the country where the contract is implemented, of fraud or corruption or any other offence committed during the procurement process or performance of a contract, unless they provide supporting information together with their Statement of Integrity which shows that this conviction is not relevant in the context of this AFD financed contract;
b. subject to an administrative sanction within the past five years by the European Union or the competent authorities of the country where they are constituted, for fraud or corruption or for any other offence committed during a procurement process or performance of a contract, unless they provide supporting information together with their Statement of Integrity which shows that this conviction is not relevant in the context of this AFD financed contract;
c. convicted within the past five years by court decision, which has the force of res judicata, of fraud or corruption or of any other offence committed in the context of an AFD-financed procurement process or performance of a contract;
3) Are listed for financial sanctions by the United Nations, the European Union and/or France for the purposes of fight against terrorist financing or threat to international peace and security;
4) Have been subject within the last five years to a contract termination fully settled against them for significant or persistent failure to comply with their contractual obligations during contract performance, unless (i) this termination was challenged and (ii) dispute resolution is still pending or has not confirmed a full settlement against them;
5) Have not fulfilled their fiscal obligations regarding payments of taxes in accordance with the legal provisions of either the country where they are constituted or the Beneficiary"s country;
6) Are subject to an exclusion decision of the World Bank and are listed on the website http:/ 点击查看>> , unless they provide supporting information together with their Statement of Integrity which shows that the exclusion is not relevant in the context of this AFD-financed project;
7) Have created false documents or have committed misrepresentation in documentation requested by the Beneficiary as part of the procurement process of this contract.
3. Conflict of interest
Except in cases duly accepted by AFD, a Person (including all members of a joint venture or any of their subcontractors) shall be disqualified in a competitive procurement process if they:
1) Are an affiliate controlled by the Beneficiary or a shareholder controlling the Beneficiary, unless the stemming conflict of interest has been brought to the attention of AFD and resolved to its satisfaction;
2) Have a business or a family relationship with a Beneficiary"s staff involved in the procurement process or the supervision of the resulting contract, unless the stemming conflict of interest has been brought to the attention of AFD and resolved to its satisfaction;
3) Are controlled by or control another bidder or are under common control with another bidder, receive from or grant subsidies directly or indirectly to another bidder, have the same legal representative as another bidder, maintain direct or indirect contacts with another bidder which allow them to have or give access to information contained in the respective bids, to influence them or influence the decisions of the Beneficiary;
4) Are engaged in a consulting services activity which, by its nature, may be in conflict with the assignments that they would carry out for the Beneficiary;
5) In the case of a procurement process for goods, works or plants:
i. Prepared or have been associated with a consultant who prepared specifications, drawings, calculations and other documentation for the procurement process;
ii. Have been recruited or are proposed to be recruited, themselves or any of their affiliates, to carry out works supervision or inspection for this contract.
6) Are state-owned entities, which are not able to provide evidence that (a) they are legally and financially autonomous and/or (b) they do operate under commercial law.
7) Consultants who took part in the project’s feasibility study are not entitled to submit an offer for any lot of the project.
4. Embargos
The Beneficiary undertakes not to acquire or supply any equipment or to operate in any sector which is subject to an embargo by the United Nations, the European Union or France.
V. Joint Venture
The Applicant shall submit only one application, either in its own name or as a member of a Joint Venture (JV). However, the same Subconsultant may participate in several applications.
If the Applicant is a JV, the expression of interest shall include:
1. A copy of the JV Agreement entered into by all members, or
a letter of intent to execute a JV Agreement, signed by all members together with a copy of the Agreement proposal;
2.JV Agreement shall indicate the leading partner of the JV and respective work scope and responsibility as well as a commitment to state that each party of the JV will assume liable responsibility to the Employer if they won the bid.
In the absence of this document, the other members will be considered as Sub-consultants.
Experiences and qualifications of Sub-consultants are not taken into account in the evaluation of the applications.
If the Applicant is a JV, members of the JV shall not be more than 6 (six) firms in total.
VI. Language of Bid
The EOI prepared by the Applicant and all correspondence and documents relating to the Bid exchanged by the Applicant, Employer and Tendering Agent, shall be written in English with accurate Chinese translation attached.
Supporting documents and printed literature that are part of the EOI may be in another language provided shall be accompanied by an accurate English and Chinese translation.
Applicants shall prepare ONE (1) original EOI in English and ONE(1) original EOI in Chinese.

6. In the context of the procurement process and performance of the corresponding contract:
