一、采购项目内容

北京市朝阳区金盏国际合作服务区管理委员会、北京市朝阳区东坝乡人民政府、北京市朝阳区水务局作为主办单位，北京京投兴朝置地有限公司作为承办单位，北京科技园拍卖招标有限公司作为征集组织机构，现举办“金盏国际合作服务区西区（东坝北西区）特色风貌与公共空间景观风貌方案征集”活动。本次方案征集活动将公开邀请具有相关规划设计经验的设计机构前来申请应征，提交资格预审申请文件（以下简称“申请文件”）。通过资格预审选取5个应征人参加征集活动，并提交应征设计成果。
Beijing Chaoyang Jinzhan International Cooperation Zone Commission, Dongba Township People"s Government of Chaoyang District, Beijing, and Bureau of Water Affairs of Chaoyang District, Beijing as the Sponsors, together with Beijing JINGTOUXINGCHAO Land Co., Ltd. as the Organizer, and Beijing Science Park Auction & Tender Co., Ltd. as the Organizer of Solicitation, are currently holding the "Solicitation of Proposals for the Characteristic Features and Public Space Landscape Styles of the West Area of Jinzhan International Cooperation Zone (Dongba North-West Zone)." Design entities worldwide with related planning and design experience are publicly invited to participate and submit the Prequalification Application Documents. The Sponsors will select five final applicants as Participants for solicitation of proposals and for them to further submit their design proposals for response.

Project name: Solicitation of Proposals for the Characteristic Features and Public Space Landscape Styles of the West Area of Jinzhan International Cooperation Zone (Dongba North-West Zone)
项目位置及规模：金盏园区西区（东坝北西区）东起北小河，南至坝河，西、北至规划亮马河北路，总用地面积约318公顷，紧邻第四使馆区、中国自由贸易试验区国际商务服务片区金盏合作服务区，是服务两区建设，突出三化定位，彰显建设国际一流和谐宜居之都的门户地区。
Project location and scale: The West Area of Jinzhan Zone (Dongba North-West Zone) starts from Beixiao River in the east, Ba River in the south, and the planned Liangmahe North Road in the west and north, with a total land area of approximately 318 hectares. Adjacent to the Fourth Embassy Zone, and Jinzhan International Cooperation Zone of International Business Service Area in China Pilot Free Trade Zone, it is a gateway area that serves the construction of the two Zones, focuses on the orientation of cultural enrichment, global growth and large-scale green space, and highlights the construction of a world-class harmonious and livable city.

Design tasks: Landscape style design of important urban waterfront public spaces in the West Area of Jinzhan Zone (Dongba North-West Zone) and on the eastern bank of Beixiao River, urban style design of Dongfeng Station Metro Micro-center Cluster, landscape style design of main urban roads and green belts along the streets, and landscape style design of important historical nodes.

4.应征申请人的资格
4. Eligibility and Qualifications of Applicants
4.1应征申请人（以下简称“申请人”）应为合法注册的法人实体或由合法注册的法人实体组成的项目联合体。
4.1 Any Applicant shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws.
4.2申请人应具有承担本征集项目规划设计的专业技术能力，且具有城乡规划（城市规划）或建筑设计或风景园林设计的相关资质或资格。
4.2 Applicants shall have the professional and technical ability to undertake the planning and design of this solicitation project, and the relevant qualifications or eligibility in urban and rural planning (urban planning), architectural design or landscape design.
4.2.1中华人民共和国境内的申请人应具有城乡规划编制甲级或建筑行业（建筑工程）设计甲级或风景园林工程设计专项甲级及以上资质。
4.2.1 Applicants within the People"s Republic of China should have Class A qualifications for the formulation of urban and rural planning or Class A qualifications for the architectural industry (architectural engineering) design or Class A qualifications for the special landscape engineering design or higher.
4.2.2中华人民共和国境外的申请人须依所在国或所在地区的管理规定具有城市规划或建筑设计或风景园林设计的执业许可或经营许可。
4.2.2 The Applicants outside the People"s Republic of China should have a practice license or business license for urban planning or architectural design or landscape design in accordance with the national or local administrative regulations.
4.3 中华人民共和国境外的应征申请人须与境内的申请人组成联合体应征。
4.3 Any applicant outside the People"s Republic of China shall form a Consortium with an applicant inside the People"s Republic of China before participating.
4.4 香港、澳门特别行政区和台湾地区的规划设计机构的资格要求参照境外设计机构资格要求的规定。
4.4 The qualifications for planning and design entities from Hong Kong and Macau Special Administrative Regions as well as Taiwan shall refer to the requirements of qualifications for design entities outside the People’s Republic of China.
4.5 本项目接受联合体应征。
4.5 This Project accepts applications from Consortia.
4.6 除联合体内部的成员外，参加征集的应征人之间不应存在关联关系。

Applicants who intend to participate in the solicitation for design proposals must first download the registration form from the website of Beijing Science Park Auction & Tender Co., Ltd. 申请文件递交的截止时间为2022年3月3日中午12时00分，申请人应在递交截止时间之前将申请文件递交至征集组织机构。主办单位/承办单位和征集组织机构将拒绝接收逾期送达的申请文件。
The deadline for submission of application documents is 12:00 noon on March 3, 2022. Applicants shall submit such documents to the Organizer of Solicitation before the deadline. The Sponsors/Organizer and the Organizer of Solicitation will reject any application documents that arrive after the specified deadline.

This announcement will be published on the China Tendering and Bidding Public Service Platform (www.cebpubservice.com), China Government Procurement Network (www.ccgp.gov.cn) , and the website of Beijing Science Park Auction & Tender Co., Ltd. (www.bkpmzb.com) at the same time. The amendment and supplement of the Announcement shall be subject to the contents released via the websites aforementioned.

8.1知识产权
8.1 Intellectual Property
8.1.1 本次方案征集接收的所有有效的应征文件均不退回。
8.1.1 All response proposals received in this solicitation will not be returned.
8.1.2 应征规划设计文件和设计成果的知识产权由主办单位/承办单位与应征人共同享有。
8.1.2 The intellectual property rights of the Design Proposals and design results shall be commonly owned by the Sponsors/Organizer and the Participants.
8.1.3 应征人对其应征设计文件享有署名权，在征得主办单位/承办单位书面同意后可通过传播媒介、专业杂志、书刊或其他形式评价、展示其应征设计文件的相关内容。除应征人的设计标准、设计导则和绘图元素以外，应征人不得将应征设计文件及设计成果用于其他的设计项目。
8.1.3 Participants hold the right of authorship for their Design Proposals and can comment on and display such Design Proposals in the forms of media communications, trade magazines, publications among others after granted with the Sponsors/Organizer’s consent in writing. Participants shall not use the Design Proposals and design results on other design projects, except the Participants’ design standards, design guides and principles, and drawing elements.
8.1.4 应征人应保证提交的应征设计文件及设计成果在中国境内或境外没有且不会侵犯任何其他人的知识产权（包括但不限于著作权、专利权）或专有技术或商业秘密。应征人应保证，如果其应征设计文件使用或包含任何其他人的知识产权或专有技术或商业秘密，应征人应已经获得权利人的合法、有效、充分的授权。应征人因侵犯他人知识产权或专有技术或商业秘密所引起的全部赔偿责任应由应征人承担。
8.1.4 Participants shall ensure that all the submitted Design Proposals and design results have not infringed upon and will not infringe upon IPRs (including but not limited to copyright and patent right) or proprietary technologies or trade secrets of others within or outside the People’s Republic of China. Participants shall guarantee that if their Design Proposals use or include IPRs or proprietary technologies or trade secrets of others, the Participants shall have already obtained legitimate, valid and sufficient authorization from the right holders. The Participants shall take all liabilities for any compensations arising from infringement upon IPRs or know-how or trade secrets of others.
8.1.5主办单位/承办单位有权在本项目的规划设计中使用应征人提交的规划设计成果，主办单位/承办单位在项目的规划设计中或在规划设计方案调整综合时可以全部或部分使用应征规划设计成果的内容，也可以对其进行修改。主办单位/承办单位不得将应征设计文件及设计成果用于本项目以外的其他项目。
8.1.5 The Sponsors/Organizer have the right to use the planning and design results submitted by the Participants in the planning and design of this Project. The Sponsors/Organizer are allowed to use the Design Proposals in whole or in part in the planning and design of this Project or the adjustment and integration of the planning and design proposals, and have the right to modify them. The Sponsors/Organizer shall not use the Design Proposals and design results for a purpose other than this Project.
8.1.6 主办单位/承办单位可以对所有应征设计文件及设计成果印刷、出版和展览，并可通过传播媒介、专业杂志、书刊或其他形式评价、展示、宣传应征设计文件及设计成果，但应注明设计机构的名称。
8.1.6 The Sponsors/Organizer can print, publish and exhibit all the Design Proposals and design results, or comment on, display and publicize the Design Proposals and design results via media communications, trade magazines, publications or by other means. The precondition is indication of the names of design entities for such design.
8.2应征设计补偿金
8.2 Compensations for Design Proposals
承办单位将向按征集文件的要求在规定的时间内提交了有效应征文件的应征人支付应征设计补偿金，金额为人民币100万元（含税）。当应征人出现下列情况时，承办单位不予支付补偿金：
The Organizer will pay compensations for Designs Proposals to Participants who have submitted valid response proposals at the specified time in accordance with the requirements of the Solicitation Documents. The amount is RMB 1.0 million (including tax). The Organizer will not pay any compensation when Participants are under any of the following circumstances:
(1) 应征人未按规定时间提交应征文件；
(1) Participants fail to submit their response proposals within the specified time;
(2) 应征人提交的应征文件经专家委员会评审被认定为未对征集文件要求作出实质性响应；
(2) The response proposals submitted by Participants are judged, upon the expert review, as not substantially responding to the requirements of the Solicitation Documents;
(3) 应征人被取消应征资格。
(3) Participants are disqualified.
8.3奖项的设置
8.3 Awards Settings
本次方案征集将评选出3个优胜设计方案。承办单位将向获得优胜奖的应征人支付人民币60万元（含税），此笔费用包括了奖励费用和方案优化并配合主办单位/承办单位完成项目方案综合的费用。
In this solicitation, three winning design proposals will be selected. The Organizer will pay RMB 600,000 (including tax) to each winning Participant. This fee includes the awards and the cost of optimizing the proposals and cooperating with the Sponsors/Organizer to complete the integration of proposals.
8.4适用法律
8.4 Governing Laws
本次征集活动本身及与本次活动相关的文件所适用的法律和法规仅为中华人民共和国的法律和法规。
The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
8.5语言
8.5 Languages
资格预审文件以及与资格预审文件相关的补充文件和澄清文件均使用中文和英文书写。申请文件应使用中文书写，申请人随申请文件提供的证明文件和印刷品可以使用另一种语言，但应附中文译本。在中文与其他语言的意思表达不一致时，以中文为准。
The language used in the Prequalification Documents and any supplement and clarification documents thereto shall be Chinese and English. Application Documents for Prequalification shall be drafted in Chinese. Another language can be used for the proof documents that the Applicant provides along with the Application Documents and printed documents, but the version with Chinese translation shall be attached thereto. In the case of inconsistent expressions in both Chinese and another language, the Chinese version shall prevail.
