哥伦比亚波哥大地铁一号线项目中压开关柜（含继电保护装置）

采购招标公告

中国港湾工程有限责任公司承接了哥伦比亚波哥大地铁一号线项目，拟对项目中压开关柜（含继电保护装置）（详见招标文件）进行招标，招标编号：METRO1/TEN/M&E/2022/0007。诚邀市场业绩和商业信誉良好且符合投标资格要求的企业参与本次招投标，本次招标采用电子化招标投标方式。

1.招标文件发放时间：2022年03月31日至2022年04月06日（北京时间）。

2.招标文件发放方式：通过中国交建供应链管理信息系统（http://114.255.239.58/PMS/）以公开招标的方式发放。

3.投标文件递交截止时间：2022年04月29日08:30（北京时间）。

4.投标文件递交地点：

（1）按规定将电子版投标文件上传至中国交建供应链管理信息系统；

5.开标地点：中国交建供应链管理信息系统

6.开标时间：投标截止日当日在中国交建供应链管理信息系统（http://empm.ccccltd.cn/）上开标，招标人有权推迟开标。

7.投标人资质要求

7.1Bidders should be legal persons registered in People’s Republic of China, Republic of Colombia or a third country, whose corporate purpose matches with the purpose of this Tender process, who are not involved in any conflict of interest under the terms established by the Tenderer, and that have experience, knowledge, and capacity to present the proposal and to celebrate and perform the contract.

投标人应是在中华人民共和国境内，哥伦比亚共和国境内或第三国注册的法人，其公司经营业务与满足本次招标要求，在招标人制定的条款下不涉及任何利益冲突，并且有经验、知识和能力提交投标书以及履行合同。

7.2The Bidders shall be the manufacturers or agents that meet all the requirements of technical specification and quality standard of products, stated in the tender documents. If the Bidder is an Agent, its registered capital shall not be less than 20,000,000.00 RMB(or the equivalent amount in USD), and the Agent shall obtain the exclusive authorization from the manufacturers for this tender in the form 8.7-2. Dealers are not acceptable for this Tender.

投标人应是满足招标文件中所列产品技术规范和质量标准等所有要求的制造商或代理商。如投标人为代理商，其注册资金应不少于2000万人民币（或等额美元），且需按照格式8.7-2的要求取得制造商针对本此招标项目的独家授权。本次招标不予考虑经销商。

7.3 The Bidder shall provide project experience information in the past five years which complies the requirements of: i) Quantity of the application case of Medium Voltage Switchgear (GIS) product in metro industry is not less than six (6), with certification issued by a railway operator or authority; ii) At least one (1) application case of Medium Voltage Switchgear (GIS) product in overseas project, with supporting documents for reference; iii) In the case that the Bidder is an agent, it should be an exclusive agency of the Medium Voltage Switchgear products that comply with the technical specification in Section-3; iv) The project experience of manufacturer can be treated as the project experience of the exclusive authorized agent.

投标人应提供近5年内符合以下要求的项目业绩资料：i）其中压开关柜(GIS)在地铁系统中的应用案例不少于6个，并经过铁路运营商或权威机构认证；ii）至少有一个中压开关柜(GIS)产品在海外项目中的应用案例，并有配套证明文件供参考；iii) 如若投标人为代理商，它应该为满足第三部分技术规范的中压柜产品的独家代理商；iv）品牌授权厂商的业绩可以作为该品牌被授权人的业绩。

7.4 Consortium bid is not acceptable for this Tender.

本次招标不接受联合体投标。

7.5 The Bidders shall not be involved in any Prohibited Practices, which include: (i) corrupt practices;(ii) fraudulent practices; (iii) coercive practices; (iv) collusive practices; (v) obstructive practices.

投标人不得参与任何禁止行为，包括：（i）腐败行为；（ii）欺诈行为；（iii）胁迫行为；（iv）串通行为；（v）妨碍行为。

7.6 The Bidders shall not be in the penalty list of Multilateral Entity.

投标人不得出现在多边金融机构的处罚名单中。

7.7 Should there be any Bidders fail to fulfil clause 3 requirement stated hereinabove; the Tenderer may invalidate and disqualify their participation in this process.

如有任何投标人不符合上述第3条的要求，招标人可取消其参与该投标程序的资格。

8.*:At this stage, the Tenderer will check whether the submitted documents meet the requirement of tender document. Tender will be rejected if the following situation is found:

在此阶段，招标人将检查提交的文件是否符合招标文件的要求。如果发现以下情况，投标人将被否决：

(1) Bidding documents which are incomplete or not substantially responsive.

投标文件不完整，或者没有进行实质性响应；

(2) The bidding document is NOT MARKED as per the instruction.

（2）投标文件未按说明进行标记。

(3) There is no authorized digital signatory and company official stamp.

无授权数字签名人和公司公章。

(4) The validity period of offer is not according to (or shorter than) the tender request.

投标文件有效期不符合（或短于）招标文件要求的时间。

(5) Any bidder who might have submitted TWO (2) different sets of tender documents in different content of offer and NOT clarifying which one is the MAIN tender content and which one is the ALTERNATIVE.

任何投标人可能已经提交了两（2）套不同报价内容的不同投标文件，并且没有清楚说明主要报价和备选报价。

(6) Bidder who has quoted more than two different unit price to a specified similar product.

投标人对指定的类似产品报价超过两个不同单价。

(7) The product and services quoted is NOT in substantial standard requested in the tender.

报价的产品和服务不符合招标文件要求的实质性标准。

(8) The Bidder didn’t submit the Bid bond according to requirements of Tender document.

投标人未按招标文件要求提交投标保证金或投标保证金不符合招标文件要求。

(9) The bidder submits the tender documents in an illegal way.

投标人以非法方式提交投标文件。

(10) The eligibility or qualification of bidder cannot meet the requirements of the tender documents.

投标人的资格不符合本招标文件规定。

(11) The agent and manufacturer of the same product participate in the tender at the same time.

同一产品的代理商与制造商同时参与投标。

The determination of the abovementioned decision shall be jointly confirmed by the Procurement Department of China Harbour Engineering Company and the Tender assessment team.

上述废标的认定由中国港湾工程有限责任公司采购部和评标专家小组共同确认。

9.投标保证金

9.1 Bidders are required to submit a bid bond of 800,000 RMB or equivalent US dollars to the Tenderer for bid security (the exchange rate of USD shall be the rate of the date issuing the security). The validity of the bid bonds shall be 270 calendar days dated from bid closing date. During this period, the Bidder shall not withdraw the bidding documents, otherwise the Tenderer shall have the right to confiscate the bid bond;

投标人须向招标人提交80万元人民币或等价美元的投标保证金（美元汇率使用保函开具当天汇率）。投标保证金的有效期应为截标日期起270个日历日。在此期间，投标人不得撤回投标文件，否则招标人有权没收投标保证金；

9.2 The bid bond format will be accepted in the form of bank guarantee, the bank guarantee can be drawn on a bank in China or Columbia and acceptable to the Tenderer. The guarantee shall be delivered to the Tenderer before the bid closing date.

投标保证金采用银行保函形式，银行保函可由招标人认可的哥伦比亚境内或中国境内的银行开具，并符合招标人的保函格式要求，在截标日期前将原件提交给招标人。

9.3 The original certificate of bid guarantee or bank transfer must be submitted to the Tenderer on the bid closing date. The form of bank transfer just applies to Chinese bidders(bank transfer needs to remark“Medium Voltage Switchgear of PLMB Project”). If bid bond is made by bank transfer, please remit it to the following bank and account number:

9.4 The bid bond will be retued to Bidder 30 days after the Tenderer sign procurement contract with successful bidder and receive the performance bond according to the requirement of the contract.

投标保证金将在招标人与中标人签订采购合同，并按合同要求收到履约保证金后30天内退还给投标人。

9.5 The bid bond shall not be retued to the bidder when following cases occurs and the Tenderer keeps the right to claim:

出现下列情况时，招标人不会向投标人退还投标保证金，并保留索赔权：

(1) The Bidder withdraws or cancel the Bid viciously within the validity date.

投标人在有效期内恶意撤回或取消投标；

(2) The successful Bidder did not supply the performance guaranty before the requested deadline.

中标人未在要求的截止时间前提供履约保函；

(3) The successful Bidder did not sign the procurement contract with the Tenderer before the requested deadline.

中标人未在要求的截止时间前与招标人签订采购合同；

(4) The successful Bidder subcontract the project to other company without the approval from the Tenderer.

中标人未经招标人批准将项目分包至其他公司；

(5) The successful Bidder did not perform the contract after signing (force majeure excluded)

中标人在签署合同后并未履行合同（不可抗力因素除外）；

(6) Other behaviors that against the Law of China and the requirement of the Tender.

其他违反中国法律和招标要求的行为。
