1、在购买和领购本项目招标文件，贵公司仅提供纸质版英文招标文件。

问题：为便于投标人更准确、充分的响应招标文件投标，贵公司能否提供该项目中、英文可编辑招标文件电子版。

1. Your company only provides the paper version of English tendering document of this project for purchase and receiving.

Question: To facilitate the bidder to respond to the tendering document more accurately and sufficiently, we wonder if your company could provide the editable electronic version of tendering document in both Chinese and English.

答复：为便于投标人准备投标文件，本澄清将随附电子版中英文招标文件（第四章和第九章）。如有需要，投标人也可与招标代理联系，获取纸质版中文招标文件以供参考。若招标文件的中文版与英文版有冲突，以英文版为准，若招标文件电子版与纸质版有冲突，以纸质版为准。

Reply: To facilitate the bidder’s preparation of Bid, electronic BD in both Chinese and English (Section 4 and Section 9)areprovided together with this Clarification. If needed, Bidders may also contact the Procurement Agent to obtain a hard copy of the BD in Chinese for reference. If there is any discrepancy between Chinese and English BD, the English BD shall prevail. If there is any discrepancy between printed and electronic BD, the printed BD shall prevail.

2、纸质版英文招标文件第六部分供货需求第7页，第4.2条款投标人提交的技术文件“（3）产品色样和测试报告：样品或测试报告中的各项参数应不低于招标文件中使用的各项参数，且能切实符合招标文件的相关要求。

问题：本招标项目合同范围包括衡阳县城乡生活垃圾收运一体化建设项目中垃圾压缩设备、钩臂车、垃圾压缩车、洗扫车、洒水车、多功能抑尘车等设备，不同品牌制造商根据车型结构特点参数不同，但均符合国家质量监督检验机构标准，出具车辆检验报告，且车辆在中华人民共和国工业和信息化部注册，道路机动车辆制造商和产品目录中，含公告参数页。该条款要求“各项参数应不低于招标文件中使用的各项参数”有不合理之处，如下列所述：

第六部分供货需求第6条款技术规格和设备标准，垃圾压缩设备

1) 结构尺寸（倾斜状态）长（mm）≥6380。容积一定情况下，箱体尺寸越小，结构越优化，对使用方越方便，此处不应大于等于。

2) 空箱重量（kg）≥6800。容积一定情况下，箱体重量越轻，轻量化结构越好，装载率越高，同时可避免超载，此处不应大于等于。

3) 垃圾箱结构：垃圾箱应采用锥形结构。箱体前小后大，便于垃圾卸载。倒锥形结构为不规则立体，垃圾压缩填充率没有规则立体高。

4) 密封：压缩机后门应装有至少六点锁紧的锁紧装置。从安全角度，点位多故障率反而高，能充分说明后门锁紧工艺安全即可。

第六部分供货需求第6条款技术规格和设备标准，车厢可卸式垃圾车

1) 整体尺寸（长x宽x高）（mm） ≥8600x2500x3150。整车尺寸长度不是越大越好，长度短整车轴距更方便。

2) 接近角/离去角（°）≤20/12 。接近角/离去角越大，整车通过性越优。

我公司认为不同品牌制造商根据车型结构特点参数不同，但均符合国家质量监督检验机构标准，能切实符合招标文件的使用要求即为符合条件。此处设置本条款“各项参数应不低于招标文件中使用的各项参数”，根据商务部1号令规定第十六条“招标人不得以招标投标法实施条例第三十二条规定的情形限制、排斥潜在投标人或者投标人”。

2. It is stated in the Paragraph 4.2 Technical documents submitted by the bidder on Page 7 of the Part VI Supply Demands in the tendering document that " (3) Product color sample and test report: the parameters in the sample or test report shall meet or be superior to the parameters used in the bidding document, and can really respond to the requirements of the bidding document."

Question: The contract scope of this tendering project includes garbage compression equipment, hook arm vehicles, garbage compression vehicles, cleaning sweeper trucks, watering trucks, multi-functional dust suppression vehicles and other equipment in Hengyang County Urban-rural Domestic Garbage Collection and Transportation Integrated Construction Project. Different brand manufacturers provide different parameters based on the structure characteristics of the vehicle model, but all the parameters provided can meet the standards of the national quality supervision and inspection administration, vehicle inspection reports have been issued, vehicles have been registered in Ministry of Industry and Information Technology of the People"s Republic of China, and the directory of road motor vehicle manufacturers and products include the announcement parameter page. This clause requires that each parameter shall meet or be superior to the parameter used in the tendering document, which is unreasonable in some c ases as described below:

Part VI Supply Demands - Article 6 Technical Specifications and Equipment Standards - Garbage Compression Equipment

1)Physical dimension (tilt condition) l ength (mm) ≥6,380. In the c ase of a certain volume, as the container size is smaller, the structure will be superior, and it is more convenient for use. So, it is unreasonable that the physical dimension (tilt condition) l ength (mm) ≥6,380.

2)Empty container weight (kg) ≥6,800. In the c ase of a certain volume, as the container weight is lighter, the lightweight structure will be better, the loading rate will be higher, and overload can be avoided, so it is unreasonable that the empty container weight (kg) ≥6,800.

3)Dustbin structure: The dustbin shall be of a tapered structure. It is convenient for unloading of waste if the front part of the dustbin is smaller than its rear part. The inverted tapered structure is an irregular stereoscopic structure, and its compression and filling rate is lower than that of the regular one.

4)Sealing: The rear door of the compressor shall be configured with a locking device of six locking nodes. f rom the perspective of safety, the fault rate will be higher as there are more locking nodes, which indicates that it is enough when the rear door locking process is safe.

Part VI Supply Demands - Article 6 Technical Specifications and Equipment Standards - Detachable Container Garbage Truck

1)Overall size (L x W x H) (mm) ≥8,600x2,500x3,150. It is not the fact that it is better as the overall size of the truck is bigger, but the spread of axles will be better as the l ength is shorter.

2)Approach angle/ departure angle (°) ≤20/12. As the approach angle / departure angle is bigger, the trafficability of the whole vehicle will be superior.

Our company thinks that different brand manufacturers provide different parameters based on the structure characteristics of the vehicle model, but all the parameters provided can meet the standards of the national quality supervision and inspection administration, and it should be regarded as requirements are met if they can practically meet the service requirements as stipulated in the tendering document. As regards the clause " the parameters in the sample or test report shall meet or be superior to the parameters used in the bidding document", it is stipulated in Article 16 of No. 1 Decree of the Ministry of Commerce "the tenderer shall not restrict or exclude bidders or potential bidders with the c ases as stipulated in Article 32 of the Implementation of the Law of the People"s Republic of China on Bid Invitation and Bidding".

答复：

（1）垃圾压缩设备

1）长度太小，会造成重心太高，在保证容积≥18m3的情况下，结构尺寸长（mm）≥6380更安全。此条技术参数不做修改。

2）为保证箱体有足够的强度与刚度，并确保设备的使用年限，空箱重量（kg）≥6800更优。此条技术参数不做修改。

3）箱体采用锥形结构便于卸料，并使得压缩后的垃圾可干净地卸除。此条技术参数不做修改。

4）为确保设备的密封性，六点锁紧技术密封效果更好。此条技术参数不做修改。

（2）车厢可卸式垃圾车

1）整车尺寸大可有效降低车辆满载时的重心高度，保证车辆行驶稳定安全。此条技术参数不做修改。

2）接近角/离去角越小车辆重心越低，车辆行驶更加安全稳定。此条技术参数不做修改。

投标人不需要完全满足招标文件第6章规定的所有技术参数，但应证明提供的货物实质上满足招标文件的技术要求。

Reply:

(1) Garbage compression equipment

1) If the l ength is too short, the center of gravity will be too high, and when the guaranteed volume is ≥ 18m 3 , the structural dimension l ength (mm) ≥ 6380 is safer. This technical parameter will not be modified.

2) In order to ensure that the box has sufficient strength and stiffness and ensure the service life of the equipment, the empty box weight (kg) ≥ 6800 is better. This technical parameter will not be modified.

3) The box body adopts a conical structure to facilitate unloading, which enables the compressed garbage be removed cleanly. This technical parameter will not be modified.

4) In order to ensure the tightness of the equipment, the six point locking technology has better sealing effect. This technical parameter will not be modified.

(2) Detachable container garbage collector

1) The large size of the whole vehicle can effectively reduce the height of the center of gravity when the vehicle is fully loaded and ensure the stability and safety of the vehicle. This technical parameter will not be modified.

2) The smaller the approach angle / departure angle, the lower the center of gravity of the vehicle and the safer and more stable driving of the vehicle. This technical parameter will not be modified.

The bidders are not required to fully meet all specified technical parameters in Section 6, but should demonstrate that the goods offered substantially meet technical requirements of the BD.

3、纸质版英文招标文件第六部分供货需求第7页，第4.2条款投标人提交的技术文件“（4）C《中华人民共和国环卫清洁服务企业国家一级资质认证证书》和D《城市生活垃圾经营性清扫、收集、运输服务许可证》”。

问题：本招标项目合同范围包括衡阳县城乡生活垃圾收运一体化建设项目中垃圾压缩设备、钩臂车、垃圾压缩车、洗扫车、洒水车、多功能抑尘车等设备的供货、调试等相关服务，是“设备供货、调试”合同，不含有“经营”。上述C和D两项要求证书是城市生活垃圾“经营性”清扫、收集、运输服务具备资质条件。根据商务部1号令规定第十六条“招标人不得以招标投标法实施条例第三十二条规定的情形限制、排斥潜在投标人或者投标人”。

3. It is stated in the Paragraph 4.2 Technical documents submitted by the bidder on Page 7 of the Part VI Supply Demands in the tendering document that "(4) C. National first-class qualification certificate of environmental sanitation and cleaning service enterprise of the People’s Republic of China and D.Business cleaning, collection and transportation service license for urban domestic waste".

Question: The contract scope of this tendering project includes supply, commissioning and other services concerning garbage compression equipment, hook arm vehicles, garbage compression vehicles, cleaning sweeper trucks, watering trucks, multi-functional dust suppression vehicles and other equipment in Hengyang County Urban-rural Domestic Garbage Collection and Transportation Integrated Construction Project. It is an equipment supply and commissioning contract, and no business operation is involved. The above two certificates (C and D) are qualifications for operational urban domestic waste cleaning, collection and transportation services. According to Article 16 of the No. 1 Decree of the Ministry of Commerce, "the tenderer shall not restrict or exclude bidders or potential bidders with the c ases as stipulated in Article 32 of the Implementation of the Law of the People"s Republic of China on Bid Invitation and Bidding".

答复：根据招标文件第6章“需求一览表”的第4.2条：“……（4）针对国内垃圾压缩设备、车厢可卸式垃圾车、自装卸式垃圾车、压缩式垃圾车、洗扫车、洒水车、多功能抑尘车、吸污车的生产厂家需增加提供以下资料（本条要求的下述资料，生产厂家需在合同谈判或设备供货前提供）……C. 中华人民共和国环卫清洁服务企业国家一级资质证书；D. 城市生活垃圾经营性清扫、收集、运输服务许可证……”，因本合同设备在运营期间需要制造商提供技术支持，因此要求国内制造商在合同谈判或设备供货前提供相关证书。请注意，以上不是对投标人本身的资格要求。

Reply: As technical support f rom the manufacturer is necessary during operation period of the equipment, we requested relevant certificates f rom domestic manufacturers before contract negotiation or equipment supply [refer to Clause 4.2 in Section 6 “Schedule of Supply” of the BD: …… (4) For domestic manufacturers of garbage compression equipment, detachable container garbage collector, hydraulic lifter garbage truck, compression type garbage truck, sweeper-washer vehicle, sprinkler, multifunctional dust suppression vehicle and sewage suction vehicle should increase the following documents (the following documents required by this clause shall be provided by the manufacturers before contract negotiation or equipment supply): ……C. National first-class qualification certificate of environmental sanitation and cleaning service enterprise of the People"s Republic of China; D. Business cleaning, collection and transportation service license for urban domestic waste ……”]. Please be reminded that the above are not qualification requirements for the bidder itself.

特此补遗和澄清。
