Tender Notice

哥伦比亚波哥大地铁一号线项目拟对项目115kV/34.5kV主变电所设备（详见招标设备清单）进行招标，招标编号：METRO1/TEN/M&E/2022/0010。诚邀市场业绩和商业信誉良好且符合投标资格要求的企业参与本次招投标，本次招标采用电子化招标投标方式。

The Bogota Metro Line 1 project in Colombia intends to bid for the 115/34.5kV Substation System Equipment of the project (see the list of bidding equipment for details). The bidding number is METRO1/TEN/M&E/2022/0010. Companies with good market performance and business reputation and meeting the bidding eligibility requirements are sincerely invited to participate in this bidding. This bidding will be in the method of electronic bidding.

1. 招标文件发放时间：2022年4月29日至2022年5月9日（北京时间）。

Bidding document issuance time: April 29^th, 2022 to May 9^th, 2022 (Beijing time).

2. 招标文件发放方式：通过中国交建供应链管理信息系统（http://empm.ccccltd.cn/PMS）以公开招标的方式发放。

The method of issuing the bidding documents: through the Supply Chain Management System of CCCC (http://empm.ccccltd.cn/PMS), it will be issued by public bidding.

3. 投标文件递交截止时间：2022年05月30日08:00（北京时间）。

Deadline for submission of bidding documents: 08:00 on May 30^th, 2022 (Beijing time).

4. 投标文件递交地点：

（1）按规定将电子版投标文件上传至中国交建供应链管理信息系统；

Place of submission of tender documents:

(1) Upload the electronic bidding documents to the CCCC Supply Chain Management Information System as required;

6. 开标时间：投标截止日当日在中国交建供应链管理信息系统（http://empm.ccccltd.cn/PMS）上开标，招标人有权推迟开标。

Bid opening time: Bids will be opened on the CCCC Supply Chain Management Information System (http://empm.ccccltd.cn/PMS) on the closing date of bidding, and the tenderer has the right to postpone the opening of the bids.

7. 投标人资质要求:

Qualification requirements for bidders:

Bidders should be legal persons registered in People’s Republic of China, Republic of Colombia or a third country, whose corporate purpose matches with the purpose of this Tender process, who are not involved in any conflict of interest under the terms established by the Tenderer, and that have experience, knowledge, and capacity to present the proposal and to celebrate and perform the contract.

投标人应是在中华人民共和国境内，哥伦比亚共和国境内或第三国注册的法人，其公司经营业务与满足本次招标要求，在招标人制定的条款下不涉及任何利益冲突，并且有经验、知识和能力提交投标书以及履行合同。

The Bidders shall be the manufacturer that meets all the requirements of technical specification and quality standard of products, stated in the tender documents. Dealers are not acceptable for this Tender.

投标人应是满足招标文件中所列产品技术规范和质量标准等所有要求的制造商。本次招标不予考虑代理商，

The Bidder shall provide project experience information in the past five years which complies the requirement of: I) Not less than five (5) The Bidder shall provide project experience information in the past five (5) years which complies the requirements of: The equipment brand provided by the Bidders is limited to inteationally known or domestically known brands in China, Ⅰ) Quantity of the application case of Substation System Equipment product in domestic similar substation project is not less than three (3), with supporting documents for reference; Ⅱ) ①-at least four (4) application cases of Substation System Equipment product in overseas project (except in Latin America) or ②-at least two (2) application cases of Substation System Equipment product in Latin American projects, either ① or ② of (Ⅱ) article is sufficient, with supporting documents for reference.

投标人应提供近5年内符合以下要求的项目业绩资料：投标人提供设备的品牌限定于国际知名或中国国内知名的品牌，Ⅰ）其主变电所（SER）设备在国内类似变电站领域中的应用案例不少于3个，并有配套证明文件供参考；Ⅱ）①-至少有四个主变电所（SER）设备产品在海外（拉丁美洲除外）项目中的应用案例，或②-至少两个主变电所（SER）设备产品在拉丁美洲的应用案例，满足（Ⅱ）条款中的①或②其中一项即可，并有配套证明文件供参考。

Consortium bid is not acceptable for this Tender.

本次招标不接受联合体投标。

The Bidders shall not be involved in any Prohibited Practices, which include: (i) corrupt practices;(ii) fraudulent practices; (iii) coercive practices; (iv) collusive practices; (v) obstructive practices.

投标人不得参与任何禁止行为，包括：（i）腐败行为；（ii）欺诈行为；（iii）胁迫行为；（iv）串通行为；（v）妨碍行为。

The Bidders shall not be in the penalty list of Multilateral Entity.

投标人不得出现在多边金融机构的处罚名单中。

Should there be any Bidders fail to fulfil clause 3 requirement stated hereinabove; the Tenderer may invalidate and disqualify their participation in this process.

如有任何投标人不符合上述第3条的要求，招标人可取消其参与该投标程序的资格。

8.The Tenderer will check whether the submitted documents meet the requirement of tender document. Tender will be rejected if the following situation is found:

招标人将检查提交的文件是否符合招标文件的要求。如果发现以下情况，投标人将被否决：

(1) Bidding documents which are incomplete or not substantially responsive.

（1）投标文件不完整，或者没有进行实质性响应；

(2) The bidding document is NOT MARKED as per the instruction.

（2）投标文件未按说明进行标记。

(3) There is no authorized digital signatory and company official stamp.

（3）无授权人数字签名和公司公章。

(4) The validity period of offer is not according to (or shorter than) the tender request.

（4）投标文件有效期不符合（或短于）招标文件要求的时间。

(5) Any bidder who might have submitted TWO (2) different sets of tender documents in different content of offer and NOT clarifying which one is the MAIN tender content and which one is the ALTERNATIVE.

（5）任何投标人可能已经提交了两（2）套不同报价内容的不同投标文件，并且没有清楚说明主要报价和备选报价。

(6) Bidder who have quoted more than two different unit price to a specified similar product.

（6）投标人对指定的类似产品报价超过两个不同单价。

(7) The product and services quoted is NOT in substantial standard requested in the tender.

（7）报价的产品和服务不符合招标文件要求的实质性标准。

(8) The Bidder didn’t submit the Bid bond according to requirements of Tender document.

（8）投标人未按招标文件要求提交投标保证金或投标保证金不符合招标文件要求。

(9) The bidder submits the tender documents in an illegal way.

（9）投标人以非法方式提交投标文件。

9.投标保证金

投标人须向招标人提交80万元人民币或等价美元的投标保证金（美元汇率使用保函开具当天汇率）。投标保证金的有效期应为截标日期起270个日历日。在此期间，投标人不得撤回投标文件，否则招标人有权没收投标保证金。投标保证金采用银行保函形式，银行保函可由招标人认可的哥伦比亚境内或中国境内的银行开具，并符合招标人的保函格式要求，对于中国投标人，也可采用银行电汇形式。在截标日期前将原件提交给招标人。

Bidders are required to submit a bid bond of800,000 RMB or equivalent US dollarsto the Tenderer for bid security (the exchange rate of USD shall be the rate of the date issuing the security). The validity of the bid bonds shall be 270 calendar days dated from bid closing date. During this period, the Bidder shall not withdraw the bidding documents, otherwise the Tenderer shall have the right to confiscate the bid bond. The bid bond format will beaccepted in the form of bank guarantee, and the bank guarantee can be drawn on a bank in China or Columbia and acceptable to the Tenderer. Chinese bidders also can submit the bid bond in the form of bank transfer. The guarantee shall be delivered to the Tenderer before the bid closing date.

投标保证金待开标后，在招标文件规定的期限内退还投标人。未中标投标人的投标保证金退还时间为招标人与中标人签订合同后的30个工作日内。中标投标人的投标保证金退还时间为双方签订合同且招标方收到履约保函原件后30个工作日内。招标人退还投标人的投标保证金或履约保函均是无息的。

The bid bond shall be retued to the bidder within the time limit specified in the bidding documents after the bid opening. The bid bond of unsuccessful bidders will be refunded within 30 working days after the tender signs the contract with the winning bidder. The bid bond of the successful bidder will be refunded within 30 working days after both parties sign the contract and the tender receives the original performance guarantee. The bid bond or performance bond retued by the tender to the bidder is interest-free.

下列任一情况发生时，投标保证金将不予退还，同时，招标人将保留进一步索赔的权力：

The bid bond shall not be retued to the bidder when following cases occurs and the Tenderer keeps the right to claim:

出现下列情况时，招标人不会向投标人退还投标保证金，并保留索赔权：

(1) The Bidder withdraws or cancel the Bid viciously within the validity date;

（1）投标人在有效期内恶意撤回或取消投标；

(2) The successful Bidder did not supply the performance guaranty before the requested deadline;

（2）中标人未在要求的截止时间前提供履约保函；

(3) The successful Bidder did not sign the procurement contract with the Tenderer before the requested deadline.

（3）中标人未在要求的截止时间前与招标人签订采购合同；

(4) The successful Bidder subcontract the project to other company without the approval from the Tenderer.

（4）中标人未经招标人批准将项目分包至其他公司；

(5) The successful Bidder did not perform the contract after signing (force majeure excluded)

（5）中标人在签署合同后并未履行合同（不可抗力因素除外）；

(6) Other behaviors that against the Law of China, and the requirement of the Tender.

（6）其他违反中国法律和招标要求的行为。
