City))的投标人资格能力要求：一基本要求
I Basic Requirements
1.参赛申请人须是国内外合法注册的独立法人企业或机构法定代表人为同一
个人的两个及两个以上法人母公司全资子公司及其控股公司，视为同一申
请人，不可同时报名。
1. The applicant must be an enterprise or institution with
independent legal persons legally registered at home or abroad. The
parent company, wholly-owned subsidiary and its holding company
composed of two or more legal persons with the legal representative
of the same person shall be regarded as the same applicant and cannot
submit the application repeatedly.
2.不接受个人或个人组合的报名。
2. Application in individuals or groups of individuals is not
accepted.
3.本项目接受联合体投标：
3. Consortium can bid for the Project, under which:
以联合体形式投标的，应具有联合体各方共同投标协议，并明确牵头人和各
成员方的工作范围权利和义务
1 There shall be a Consortium Agreement jointly signed by all
members of the consortium, indicating the scope of work, rights and
obligations of the leader and each member
以联合体形式投标的，联合体成员至少一方应满足投标企业应具有的条件要
求
2 At least one member meets the requirements for the bidding
enterprise
联合体成员不得超过3家
3 At most 3 members are in the same consortium
联合体各方不得再以单独名义或组成新的联合体参加本项目的投标。
4 Any member shall not participate in the bidding under its own
name or a new consortium.
二资质及业绩要求
II Requirements on Qualification and Performances
1.申请单位须具备城乡规划编制甲级或建筑行业甲级。
1. The applicant must have Grade A qualification in urban and rural
planning or construction industry.
2.申请单位要求拥有2项以上含2项对标城市设计业绩。
2. The applicant is required to have 2 or more achievements in
benchmarking urban designs.
3.主创设计师须由在2018年3月1日后主持过1项以上含1项对标项目。
3. The chief designer must have hosted 1 or more benchmarking
projects since March 1, 2018.
三主创设计师要求
III Requirements on the Chief Designer
主创设计师须直接参与负责本项目，参与本次方案征集全过程，包括但不限于
出席踏勘答疑会及方案汇报等。如发现主创设计师与初选文件所提交人员不符
，征集单位有权取消该团队的参赛资格。
The chief designer must directly participate in the Project and the
whole process of the proposal solicitation, including but not limited
to attending the QA and scheme report meetings for site survey
works. If the chief designer is found to be inconsistent with that
appointed in the preliminary selection document, the Solicitor has
the right to cancel the qualification of the team.
为保证设计人员对本次方案征集的背景和相关要求有准确理解，主要设计人员
中应至少有一名以汉语为母语的成员。
In order to ensure that the designers have an accurate understanding
of the background and relevant requirements of this scheme
solicitation, at least one of the designers shall be native to
Chinese.

本项目允许联合体投标。

一征集规则
I Solicitation Rules
本次城市设计采取公开征集的方式，分为三个阶段进行，第一阶段为公告及报
名阶段第二阶段为初选阶段第三阶段为竞赛阶段。
The public solicitation of urban design will be conducted in three
stages, namely the announcement and application in the first stage,
the preliminary selection in the second, and the competition in the
third.

2有意参加方案设计竞赛的设计单位在规定时间内按要求提报报名资料，确
认报名后获得设计任务书。
2 Any design institute that proposes to participate in the scheme
design competition shall submit an application as required within the
specified time, and then obtain the design assignment after the
application is confirmed.
3项目一次踏勘及组织方答疑。
3 The primary site survey of the Project and the organizers QA
session will be conducted.
2.初选阶段
2. Preliminary selection
1初选评委会由5人以上含5人单数专家代表组成
1 The preliminary selection committee is composed of 5 or more
in singular experts and representatives.
2初选评委会将对参赛申请人的初选文件进行评审，经征集人确定后择优选
定5个入围团队。
2 The Committee will review the preliminary selection documents
and submit them to the Solicitor for confirmation, after which the
best five will be shortlisted.
3.城市设计方案竞赛阶段

1征集人组织实地踏勘，入围团队需派项目负责人主创设计师及主要设计
人员出席踏勘

shortlisted teams shall send their project leader, chief designer and
key designers
2入围团队按相关规定及设计任务书要求，提交竞赛设计成果文件暗标

2 The shortlisted teams shall submit the design proposals for the
competition sealed bid according to the relevant regulations and
the design assignment
3评审委员会由5人以上含5人单数专家组成

4评审委员会将对5位入围团队提交的竞赛设计成果文件进行评审，择优选
定本次方案征集的一等奖1名二等奖1名三等奖3名。
4 The Committee will review the design proposals submitted by the
five shortlisted teams, upon which one first prize, one second prize
and three third prizes will be awarded.
二奖金设置
II Prizes
一等奖1名，将获得深化合同，合同金额为120万元人民币含税。
The first prize: 1 winner who will be awarded the detailed design
contract at a price of 1.2 million yuan tax included.
二等奖1名，将获得奖金50万元人民币含税。
The second prize: 1 winner who will receive a bonus of 500,000 yuan
tax included.
三等奖3名，将获得奖金30万元人民币含税。
The third prize: 3 winners who will receive a bonus of 300,000 yuan
tax included.
特别说明：
Special remarks:
洋河镇驻地片区城市设计合同将直接授予本次征集一等奖获得机构含联合体
，若一等奖获得机构含联合体放弃签订合同，则顺延授予第二名，依次
类推。
The urban design contract for Yanghe Town area will be directly
awarded to the first prize winner including consortium if any. If
the first prize winner including consortium gives up on the
awarded contract, the contract will go to the second prize winner,
and so on.
获得一等奖的参赛申请人联合体将获得深化合同，作为主要设计单位，吸
收各方案亮点与专家评审意见，进行后续城市设计方案整合工作，负责城市设
计编制工作详见合同。以上获奖单位均作为洋河镇特色小镇建设战略合作
单位，为下一步项目实施过程中规划建筑设计工程咨询等入库设计和咨询单
位。
The applicant or consortium who won the first prize shall be
awarded the detailed design contract. The winner shall incorporate
the highlights of all design proposals and any expert comments into
its design, carry out the follow-up urban design work, and be held
responsible for preparing the urban design work Refer to the
contract for details. All of the above prize winners will become
strategic partners of the Yanghe Town project and will be listed in
the think tank of design and consultation institutions that may
contribute to architectural design, engineering consulting, etc. in
the implementation phase of the project.
三奖金支付
III Bonus payment
本次方案征集二等奖三等奖获得单位含联合体在中标公示结束且没有
异议后，分别与洋河镇政府签订设计方案补偿协议，办理设计补偿费相关支
付手续。
The second and third prize winners including consortium if any
shall sign a design cost compensation agreement with the Yanghe Town
government respectively to get the relevant payment for design
compensation after the contract award announcement period comes to an
end when no objections are raised.
四其他事项
Miscellaneous
1.申请单位含联合体需保证所有报名材料真实合法和有效，并承担相关
法律责任。
1. The applicant including consortium if any shall ensure the
authenticity, legality and validity of all application materials, and
bear relevant legal responsibilities in violation thereof.
2.设计方案应为原创，未以任何形式公开发表。设计方案或任何用于创作参选
作品的素材均不得侵犯第三方的任何著作权商标权专利权及其他权利。若
发生由此造成的任何纠纷，一切法律责任及给征集人造成的损失由应征人负责
。
2. The proposed design shall be original and not published in any
form. The design proposal or any materials used to create the works
shall not infringe any copyright, trademark right, patent right and
other rights of any third party. In case of any dispute arising
therefrom, all legal liabilities and losses caused to the Solicitor
shall be borne by the applicant.
3.申请单位含联合体提交的报名文件与设计成果文件若不满足征集文件要
求则视为无效投标。
3. Any documents and design deliverables submitted by the applicant
including consortium if any that deviate from the requirements of
the solicitation documents shall be deemed to be null and void.
4.所有参加本次投标的申请单位在投标期间的一切费用均由申请单位自理。
4. All expenses incurred by any applicant for the bidding shall be
borne by the applicant itself.
5.本次征集活动一等奖二等奖三等奖获奖机构提交的设计成果的知识产权
归胶州市洋河镇人民政府所有，其他任何单位和个人未经授权不能擅自使用设
计成果进行商业活动。
5. The intellectual property rights of the design deliverables
submitted by the first prize, second prize and third prize winners in
this solicitation belong to the Peoples Government of Yanghe Town,
Jiaozhou City, and shall not be used for any other commercial
activities by any company or individual without prior authorization.
6.在方案深化整合阶段，第二名第三名应征机构须提供设计资料，配合方案
深化整合工作，一旦通过资格预审，则视为接受本条款说明。
6. The second and third prize winners shall submit the design data
and play a part in the deepening and integration of the design. The
winners shall be deemed to accept this clause once they are pre-
qualified.
7.该公告涉及的设计要求以设计任务书为准。
7. The design specifications attached to the announcement shall be
the guide for design.
8.入围或征集结果确定后，征集人代理机构均不对未入围或未中选团队就评
审过程以及未能胜出的原因做任何解释，同时亦不退还设计成果文件。参赛申
请人不得向评委会成员或其他有关人员索问评审过程的情况和材料。
8. After the determination of the shortlist or the result of the
solicitation, neither the Solicitor nor the agency will give any
explanation on the evaluation basis or criteria, nor will they return
any deliverables. Applicants are not allowed to ask for any
information or materials of the evaluation process from the reviewers
or anyone.
9.本项目代理服务费由获奖单位缴纳，为设计补偿金额的1.5%。
9. The service charges payable to the agency shall be paid by the
award winner, which is 1.5% of the design compensation amount.
10.该公告涉及时间均以北京时间为准。

一项目背景
I Background
中国
上海合作组织地方经贸合作示范区简称上合示范区是习
近平总书记赋予青岛的国之重任，是赋予青岛承载一带一路
国际合作新平台的国家纵深开放战略新使命。
To develop China-SCO Local Economic and Trade
Cooperation Demonstration Zone hereinafter referred to as the
SCO Demonstration Zone is a national task assigned to
Qingdao by General Secretary Xi Jinping, and a new strategic
mission to serve as a new international cooperation platform for
Chinas in-depth opening-up under the Belt and Road Initiative.
上合示范区范围覆盖青岛全域，按照1个核心区N个联
动区进行布局建设。其中核心区位于胶州，面积61.1平方公里
，包括36.7平方公里的 胶州经济技术开发区和24.4平方公里的概
念性规划新区。
The SCO Demonstration Zone covers the whole jurisdictions of
Qingdao, with a layout comprised of one core zone and several
linkage zones. The 61.1-square-kilometer core zone is wholly

located in Jiaozhou, including 36.7 square kilometers of Jiaozhou
Economic and Technological Development Zone and 24.4 square
kilometers of conceptual planning new area.
胶州市紧抓上合战略机遇，按上合策源临空支持胶州
托底全域联动总体发展思路，形成123N的高质量发展
规划体系，其中：1是上合示范区核心区，2是上合大道总
部经济发展轴和融合大道产业振兴发展轴，3是三个重点发展
片区，N是遍布全市重点推进的N个高质量产业项目。
Jiaozhou City, seizing the SCO-related strategic opportunity
and following the general development philosophy summarized as
taking the SCO as the power source, the airport as the support, and
Jiaozhou City as the base to motivate all areas, forms the 1 2 3
N layout for high-quality development, where: 1 refers to core
zone of the SCO Demonstration Zone 2 refers to the SCO Avenue
Headquarters Economy Development Axis and the Ronghe Avenue
Industrial Revitalization Development Axis 3 refers to the three
key development zones N means the several key high-quality
industrial projects throughout the whole city.
洋河镇位于上合核心区西侧，融合大道产业振兴发展轴将
镇驻地区域和上合示范区联系在一起。洋河镇全域约129平方公
里，具有独特的生态人文底色和自然资源禀赋，从南向北形成
三大特色发展区：南部为上合国际绿色产业融合发展区，中部

为艾山资源引领的北方特色山地文旅度假区，北部为现代科技
农业引领的科技田园发展区位于北部的镇驻地和南部的绿色
产业融合发展区是上合新区建设的二级城市功能核心节点，中
部的北方特色山地文旅度假区是围绕艾山风景区和自然资源发
展的特色农文旅区域，构建了鲜明的乡村发展的富民产业体系
，承载着青岛艾山乡村振兴示范片区创建的重要功能。
Yanghe Town is to the west of the core zone, connected to the
SCO Demonstration Zone via the Ronghe Avenue Industrial
Revitalization Development Axis. With superior ecology, unique
culture and abundant natural resources on its land of about 129
square kilometers, Yanghe Town fosters three distinctive
development zones: the SCO International Green Industry
Integration Development Zone in the south, the North China
Characteristic Mountain Cultural Tourism Resort based on Aishan
Mountain in the middle, and the Technological Pastoral
Development Zone empowered by modern agricultural technology
in the north the north area where the town government is located
and the Green Industry Integration Development Zone in the south
are both the secondary core urban functional nodes of the SCO New
Area the North China Characteristic Mountain Cultural Tourism
Resort in the middle is an agriculture-featured cultural tourism resort
based on the Aishan Mountain Scenic Spot and the natural

resources, an industrial system to thrive rural areas and enhance
peoples livelihood, and an indispensable factor for Aishan
Mountain to be a Qingdao municipal demonstration area of rural
revitalization.
洋河镇驻地规划面积约0.8平方公里，按照市委市政府统
一部署，坚持世界眼光国际标准上合策源胶州特色，
着力建设成为上合国际绿色合作承载地生态城市形态展示新
高地对外开放新窗口，将成为生态城市示范区现代服务业
高质量发展样板区和大都市现代农业产业能级提升的重要增长
极，为此，开展上合新区生态田园小镇胶州市洋河镇驻地片
区城市设计方案国际征集工作，以高水平规划引领镇驻地的
生态绿色城区建设，开创洋河镇的科技人文生态三位一
体发展格局，彰显洋河镇镇驻地城市中的田园田园中的城市
的新发展形象。
The Yanghe Town area covers approximately 800,000 square
meters. It, following the instructions of the CPC Municipal
Committee and the Municipal Peoples Government and adhering to
the philosophy of global vision, international standards, SCO as the
driver and distinctive Jiaozhou features, focuses on growing into a
carrier for the international green cooperation among the SCO
countries, a new highland to display ecological urban forms, a new
window for opening-up, a demonstration zone of the ecological city,

a model of high-quality development of the modern service industry
and an important driver to improve the capacity and level of the
modern agricultural industry in the metropolis of Qingdao.
Therefore, we start the international solicitation of the design
proposals for SCO New Area Eco-pastoral Town (at Yanghe
Town, Jiaozhou City), in a bid to use high-level planning to guide
the ecological and green urban development of the town, and thus to
realize the integrated development of technology, culture and
ecology and manifest the new development image of the Yanghe
Town Area featuring perfect combination of the urban and pastoral
style.
本次国际征集旨在面向全球公开征集最能体现洋河镇的定
位与特色，同时综合考虑具有落地性兼顾建设成本的城市设
计方案，鼓励国内外优秀机构积极参与，为洋河镇发展出谋划
策。
The international solicitation aims to obtain the design proposal
that best reflects the positioning and characteristics of Yanghe Town
with good feasibility and an acceptable construction cost. All
excellent engineering institutions from around the world are
welcome to contribute wisdom to the development of the Yanghe
Town.

Featuring perfect combination of the urban and pastoral style,
Yanghe Town, following the industry-city integration development
strategy interpreted as Promoting the Green Industrial Cooperation
Among the SCO Countries, Taking Lead in the Technological
Innovation for the Future Development of Agriculture, Improving
Functions of the Mountain-based Cultural Tourism Resort, and
Enhancing the Urban Tourism Services and through high-level
urban design and overall development, is expected to generate a
strategy to improve peoples livelihood, culture, land development,
industries and sceneries in a well-coordinated manner, as well as a
planning proposal that enables the green ecological urban
development and endows the spaces with a unique style, thus to
build itself into:

the foundation for agricultural cooperation among the SCO countries
and focusing on the development connotation of future urban

Cluster will build an innovation base, a pilot test center and a
technology industrial park, gathering the world-leading healthy
agriculture philosophy, green agricultural technologies and smart
agricultural facilities and systems. It will serve the SCO countries
and work as a test field for joint innovation of all SCO countries,
and converging vitality and elements at Yanghe Town for future

Public Service Hub for Modernized Town. It will improve all
public service facilities within the town and create a pedestrian-
friendly public space with complete services and a park system
shared by all urban and rural residents as well as tourists with
different needs.
三设计范围
III Scope of Design
本次城市设计方案国际征集总体城市设计核心区由四块地
块组成，总面积约80公顷1200亩。运用城市设计方法，整
体统筹协调各类空间资源的布局与利用，合理组织开放空间
体系与特色景观风貌系统，提升城市空间品质与活力。
The core area for the international solicitation of design
proposals consists of four plots, with a total area of about 80
hectares (about 800,000 m2). Urban design methods shall be adopted

to comprehensively plan and coordinate the layout and utilization of
various spatial resources, and reasonably organize open space
systems and characteristic landscape style systems, striving to
enhance the quality and vitality of urban space.

The proposals shall study and put forward the overall image of
the town from a macro perspective, determine the features of the
town, define the spatial pattern of the town, organize the public
space system, improve the landscape framework, build an ecological
network, and optimize the overall spatial order of the town. Among
them, the initiated zone is located to the north of Ronghe Avenue,
which aims to build a higher-quality town area through refined
design. The design proposals shall present the design principles of
building volume, interface, style, color, fifth facade, and skyline in
combination with the planning and layout, to shape a town style with
regional characteristics. Moreover, from the perspective of human
experience and needs, the design proposals shall also make a
detailed research on the scale and form of various public spaces to
create a people-oriented charming landscape environment, and give
top priorities to both sides of Ronghe Avenue and Xishi Road in the
design.

项目用地主要用地由冷家村南赵家村两个驻地村的居住
用地及服务周边的洋河镇公共服务设施用地构成，北侧为洋河

东侧为农田及园林地西侧为曲家芦村南侧为农田及园林
地。场地较为平整，规划须保留地块4处
现状中心小学现状多层住宅楼现状商超及在建卫生院，其
余用地均可在规划中予以优化调整。
The project land is composed of the residential land of Lengjia
Village and South Zhaojia Village as well as the land for
surrounding public service facilities in Yanghe Town. It adjoins the
Yanghe River to the north, farmland and garden land to the east and
south, and Qujialu Village to the west. The site is relatively flat, and
four plots must be retained in the planning: the existing central
primary school, the existing multi-storey residential buildings, the
existing shopping mall and supermarket as well as a health center
under construction. The rest on the project land can be adjusted in
the planning.

项目用地中部有东西向横穿的融合大道，为红线宽度76米
快速路，是联动上合核心区与西南三镇乡村振兴板块的空间发
展轴线南北向纵穿的西石路，为红线宽度24米的生活型干路
项目内其他现状道路均可规划设计中予以优化调整。
In the middle of the project site, Ronghe Avenue, an east-west
expressway with a red line width of 76 m, serves as the spatial
development axis connecting the core area of the SCO New area and

the three towns for demonstrating rural revitalization in the
southwest and Xishi Road, running from north to south, is a main
road for peoples livelihood, with a red line width of 24 m. Other
existing roads on the project land can be adjusted in the planning
and design.

本的设计原则，提倡可持续发展理念，打造国际生态绿色城区

It is expected that the design proposals will be able to improve
the pattern of the Yanghe Town area based on international
perspectives. In combination with the current function, traffic and
land characteristics, the design principle of people first shall be
followed, and the concept of sustainable development shall be
advocated to create a new benchmark for international eco-friendly
town areas.
通过高品质的城市设计，在融合大道北部，规划行政服务
中心和未来国际农业合作枢纽中心及生态发展展示中心上合
国际社区四大功能，塑造鲜明的上合新区生态田园客厅形象

Four major functional zones to the North of Ronghe Avenue,
including an administrative service center, a future international
agricultural cooperation hub, an ecological development exhibition
center, and an SCO international community, shall be included in
the high-quality design proposals, thus shaping a distinctive image
of SCO New Area Ecological Pastoral Cooperation Hub. Among
them, the ecological development exhibition center shall be
composed of Yanghe Digital Ecological Pavilion, Aishan Geo-
culture Pavilion, and China One Town One Product Pavilion, the
SCO International Agricultural Cooperation Hub be composed of
SCO Integrated Service Hub, Supply Chain Digital Hub, and
International Cooperation Base, and the SCO International
Community be composed of SCO International Youth Talent Center,
Green Enterprise Headquarters Apartment and International
Entrepreneurship Loft. To the south of Ronghe Avenue, an

ecological pastoral community integrating tourism and living shall
be planned, which shall consist of a culture and tourism innovation
center, a culture and tourism science and technology park, a tourism

for land use and the detailing of urban land use are expected based
on the four functional divisions see the above figure for details
and relying on characteristic resource elements, so as to create a
clear, orderly and distinctive spatial order and functional layout, and
thus build an eco-friendly town area.
建筑形态与风貌组织
因地制宜结合区域整体山水格局，合理处理城镇与自然要素的
空间关系，完善高度分区天际轮廓线导控，明确重要地标
景观点和视廊，对建筑体量色彩密度风格等提出引导要
求，强化空间艺术性，形成重点突出错落有致的整体风貌特
征。加强对地标性建筑的形象塑造及功能业态的研究。
Architectural form and style synergy. Taking into account the
local conditions such as the overall landscape pattern of the area, the
design proposals shall reasonably deal with the spatial relationship
between the town area and natural elements, improve the control
over height zoning and horizon contour, clearly define important
landmarks, landscape spots and sight lines, put forward guidance for
building volume, color, density and style, and highlight spatial
artistry, thus forming an overall style that highlights key points and

features picturesque disorder. In addition, efforts shall be made to
the research on the image shaping and functional formats of
landmark buildings.

突出地域文化人文精神和场所功能性与体验性，从人的体验
感知和需求出发，优化生态空间公共空间系统，强化公共空
间及周边的人性化设计引导。深化道路系统设计，合理组织慢
行道路游览线路等公共活动通道，明确广场公园绿地滨
水空间通风廊道等重要开放空间的设计导控要求，对重要节
点的景观小品雕塑城市家具标识系统地面铺装景观
照明等设施提出引导要求，提升城市公共环境的艺术性。
Public space and ecological landscape. The proposals shall give
prominence to regional culture, humanistic spirit, and place
functionality and experience, and optimize the ecological space and
public space systems from the perspective of experience-based
human perception and needs, so as to strengthen the humanized
design guidance of public space and surrounding areas. Regarding
the in-depth design of the road system, the proposals shall
reasonably design slow-traffic roads, tourist routes and other public
activity channels, clarify the design guidance and control
requirements for important open spaces such as squares, green park
space, waterfront space, and ventilation corridors, and put forward

guidance requirements for the facilities at key points, such as
landscape sketches, sculptures, urban furniture, signage system,
ground pavement and landscape lighting, thus improving the artistry
of the public environment of the town.

计引导，管控地下空间重点建设区和重要公共设施安排，统筹
地上地下交通组织与连通，构建地面行人友好型的交通出行环

等设计管控指标，明确开发建设总量各地块地上地下开发指
标和导控要求，并提出实施城市设计的时序安排与措施建议。
Coordinated planning of aboveground and underground parts to
optimize control indicators. The proposals shall take in account the
functional attributes of the underground space in a comprehensive
manner, strengthen the guidance for integrated design of the
aboveground and underground space, control the arrangement of key
construction zones and important public facilities in the underground
space, and coordinate the aboveground and underground traffic
organization and connectivity, in a bid to build a pedestrian-friendly
traffic and travel environment on the ground. Besides, innovation
shall be made on design control indicators such as town shape
outline, street interface, key public space and green space, so as to

clarify the total development and construction amount, the
aboveground and underground development indicators and control
requirements of each plot, and put forward the schedule and
measures for implementing the town design.

一基本要求

创设计师与初选文件所提交人员不符，征集单位有权取消该团
队的参赛资格。
The chief designer must directly participate in the Project and
the whole process of the proposal solicitation, including but not
limited to attending the QA and scheme report meetings for site
survey works. If the chief designer is found to be inconsistent with
that appointed in the preliminary selection document, the Solicitor
has the right to cancel the qualification of the team.
为保证设计人员对本次方案征集的背景和相关要求有准确
理解，主要设计人员中应至少有一名以汉语为母语的成员。
In order to ensure that the designers have an accurate
understanding of the background and relevant requirements of this

Application submittals: The application form see the attached
form for the format shall be attached with the business license or
valid organizational registration documents in case of a
consortium, each member shall provide the consortium agreement
separately, qualification certificates, and identity certificate of the
legal representative with a copy of the ID card. If the applicant
entrusts an agent, the valid power of attorney shall be submitted
with copies of the ID cards of the authorizer and the authorized
person. If the legal representative or authorized person is from a
foreign country, a copy of passport shall be attached. If a consortium
submits a bid, the ID of the leading party shall be submitted. The

Part VII Design Cost Compensation
一奖金设置
I Prizes
一等奖1名，将获得深化合同，合同金额为120万元人民币
含税。
The first prize: 1 winner who will be awarded the detailed
design contract at a price of 1.2 million yuan tax included.
二等奖1名，将获得奖金50万元人民币含税。
The second prize: 1 winner who will receive a bonus of
500,000 yuan tax included.
三等奖3名，将获得奖金30万元人民币含税。
The third prize: 3 winners who will receive a bonus of 300,000
yuan tax included.
特别说明：
Special remarks:
洋河镇驻地片区城市设计合同将直接授予本次征集一等奖
获得机构含联合体，若一等奖获得机构含联合体放弃
签订合同，则顺延授予第二名，依次类推。
The urban design contract for Yanghe Town area will be
directly awarded to the first prize winner including consortium if

any. If the first prize winner including consortium gives up
on the awarded contract, the contract will go to the second prize
winner, and so on.
获得一等奖的参赛申请人联合体将获得深化合同，作
为主要设计单位，吸收各方案亮点与专家评审意见，进行后续
城市设计方案整合工作，负责城市设计编制工作详见合同
。以上获奖单位均作为洋河镇特色小镇建设战略合作单位，为
下一步项目实施过程中规划建筑设计工程咨询等入库设计和
咨询单位。
The applicant or consortium who won the first prize shall
be awarded the detailed design contract. The winner shall
incorporate the highlights of all design proposals and any expert
comments into its design, carry out the follow-up urban design
work, and be held responsible for preparing the urban design work
Refer to the contract for details. All of the above prize winners
will become strategic partners of the Yanghe Town project and will
be listed in the think tank of design and consultation institutions that
may contribute to architectural design, engineering consulting, etc.
in the implementation phase of the project.
二奖金支付
II Bonus payment

本次方案征集二等奖三等奖获得单位含联合体在中
标公示结束且没有异议后，分别与洋河镇政府签订设计方
案补偿协议，办理设计补偿费相关支付手续。
The second and third prize winners including consortium if
any shall sign a design cost compensation agreement with the
Yanghe Town government respectively to get the relevant payment
for design compensation after the contract award announcement
period comes to an end when no objections are raised.
三其他事项
III Miscellaneous
1.申请单位含联合体需保证所有报名材料真实合法
和有效，并承担相关法律责任。
1. The applicant including consortium if any shall ensure
the authenticity, legality and validity of all application materials, and
bear relevant legal responsibilities in violation thereof.
2.设计方案应为原创，未以任何形式公开发表。设计方案
或任何用于创作参选作品的素材均不得侵犯第三方的任何著作
权商标权专利权及其他权利。若发生由此造成的任何纠纷
，一切法律责任及给征集人造成的损失由应征人负责。
2. The proposed design shall be original and not published in
any form. The design proposal or any materials used to create the
works shall not infringe any copyright, trademark right, patent right

and other rights of any third party. In case of any dispute arising
therefrom, all legal liabilities and losses caused to the Solicitor shall
be borne by the applicant.
3.申请单位含联合体提交的报名文件与设计成果文件
若不满足征集文件要求则视为无效投标。
3. Any documents and design deliverables submitted by the
applicant including consortium if any that deviate from the
requirements of the solicitation documents shall be deemed to be
null and void.
4.所有参加本次投标的申请单位在投标期间的一切费用均
由申请单位自理。
4. All expenses incurred by any applicant for the bidding shall
be borne by the applicant itself.
5.本次征集活动一等奖二等奖三等奖获奖机构提交的
设计成果的知识产权归胶州市洋河镇人民政府所有，其他任何
单位和个人未经授权不能擅自使用设计成果进行商业活动。
5. The intellectual property rights of the design deliverables
submitted by the first prize, second prize and third prize winners in
this solicitation belong to the Peoples Government of Yanghe
Town, Jiaozhou City, and shall not be used for any other commercial
activities by any company or individual without prior authorization.

6.在方案深化整合阶段，第二名第三名应征机构须提供
设计资料，配合方案深化整合工作，一旦通过资格预审，则视
为接受本条款说明。
6. The second and third prize winners shall submit the design
data and play a part in the deepening and integration of the design.
The winners shall be deemed to accept this clause once they are pre-
qualified.
7.该公告涉及的设计要求以设计任务书为准。

8.入围或征集结果确定后，征集人代理机构均不对未入

8. After the determination of the shortlist or the result of the
solicitation, neither the Solicitor nor the agency will give any
explanation on the evaluation basis or criteria, nor will they return

I. The confidential information mentioned in the Undertaking
refers to any relevant information disclosed by your party to the
Undertaker in any form including but not limited to those in

writing, orally, or in the form of samples, templates, computer
programs, electronic data and so on.
二承诺方严格按照中华人民共和国保守国家秘密法
中华人民共和国保守国家秘密法实施条例计算机信息系
统保密管理暂行规定国家秘密载体保密管理的规定中
华人民共和国统计法中华人民共和国统计法实施条例等
相关法律法规及管理文件要求，对保密资料进行有效管理，做
好安全保密工作。
II. The Undertaker shall effectively manage the confidential
information and keep it secure and confidential in strict accordance
with the requirements of relevant laws, regulations and management
documents such as the Law of the Peoples Republic of China on
Guarding State Secrets, the Implementation Regulations of the Law
of the Peoples Republic of China on Guarding State Secrets, the
Interim Provisions on the Secrecy Management of Computer
Information Systems, the Provisions on the Secrecy Management of
State Secret Carriers, the Statistics Law of the Peoples Republic of
China, and the Implementation Regulations of the Statistics Law of
the Peoples Republic of China.
三承诺方为保密资料的安全管理者。提供的有关资料仅
限用于，承诺方不得将保密资料用于此用途以外的工作不得
以商业目的使用该资料或者开发和生产其他产品承诺方可根

据需要对资料内容进行必要的修改和对数据格式进行转换，但
未经许可，不得将修改转换后的数据对外发布和提供承诺
方不得将提供的有关资料在计算机互联网上传输登载并且
承诺方不得私自将提供的有关资料以及对资料修改后的内容转
让与他人非法使用。
III. The Undertaker shall be a reliable manager of the
confidential information. The relevant information provided shall be
used only for its intended purposes, and the Undertaker shall not use
the confidential information for any work other than these purposes.
The information is not allowed to be used for commercial purposes
or for development and production of other products. The
Undertaker is allowed to make necessary modifications to the
content of the information and convert the data formats as required,
but the modified or converted data shall not be released or made
available to another party without permission. The Undertaker shall
not transmit or post the relevant obtained information on the
Internet. Moreover, the Undertaker shall not transfer the relevant
obtained information or any modified content of the information to
others for illegal use without permission.
四承诺方存放保密资料的设施与条件应符合国家保密
消防及档案管理的有关规定和要求。资料仅限于使用，不得用
于其他目的。

IV. The Undertakers facilities and conditions to store the
confidential information shall comply with the relevant provisions
and requirements of China in terms of secrecy, fire protection and
archives management. The information is for use only, instead of
other purposes.
五本承诺书长期有效，直至本承诺书所包括的全部保密
信息事实上已进入公有领域而成为非保密信息但因承诺方违
反本合同的约定进行披露而导致该等资料信息成为公众所能
普遍获取的资料信息除外，或者贵单位放弃了保密要求。
V. This Undertaking shall remain in force for a long term until
all confidential information included has been actually disclosed to
the public and becomes non-confidential except for data and
information that are generally available to the public due to the
disclosure of the Undertaker in violation of the provisions of this
contract, or your party has waived the confidentiality
requirements.
六承诺方应对其相关雇员顾问的行为负责，如相关雇
员顾问违反本承诺书的规定，披露相关保密资料并造成贵单
位损失时，承诺方同意为其雇员顾问承担连带责任，贵单位
可向承诺方追究相关责任，包括金钱赔偿及其它救济。贵单位
有权要求以实际履行禁令和其它办法救济为违约的补偿。

VI. The Undertaker shall be responsible for the behaviors of its
relevant employees and consultants and agree to be jointly liable if
its relevant employees and consultants violate the provisions of the
Undertaking, disclose relevant confidential information and thus
cause losses to your party. Your party shall reserve the right to claim
indemnity against the Undertaker for monetary compensation and
other remedies. Your party shall be entitled to claim compensation
for breach of contract in forms of actual performance, injunction and
other remedies.
七承诺方违反本承诺书的任何规定，均构成违约。承诺
方应当对其违约行为给贵单位造成的损失承担赔偿责任包括
但不限于贵单位因此而支出的鉴定费律师费及差旅费。
VII. Any violation of the Undertaking by the Undertaker shall
constitute a breach of contract. The Undertaker shall assume the
compensation liability for your losses due to its breach of contract
including but not limited to the appraisal fees, attorney fees and
travel expenses paid by your party arising therefrom.
八本承诺书自签章之日起生效。
VIII. The Undertaking shall come into force since the date of
signing and sealing.
九本承诺书一式两份，具同等法律效力，分别由提供方
承诺方存档备查。

IX. The Undertaking is made in duplicate, both with the same
legal effect, and shall be archived by the provider and the
Undertaker respectively for future reference.

II. During this competition, any legal commitment made by the
legal representative or authorized agent of the consortium leader to
the Solicitor in accordance with the solicitation document and the
competition content, including written clarification and response,
shall be binding on all members. If the consortium wins the award
and the contract, its members shall jointly perform all the obligations
to the Solicitor or his agent, and bear joint and several liabilities to
the Solicitor for the matters agreed upon in the contract.
