一、采购项目内容

北京市规划和自然资源委员会、北京市房山区人民政府作为主办单位，北京市规划和自然资源委员会房山分局、北京市房山区良乡大学城管理委员会作为承办单位现举办“良乡大学城（房山新城中心区）城市设计国际方案征集”活动。本次方案征集活动将公开邀请具有相关规划设计经验的设计机构前来申请应征，提交资格预审申请文件（以下简称“申请文件”）。通过资格预审选取4个应征人参加征集活动，并提交应征设计成果。
Beijing Municipal Commission of Planning and Natural Resources and Fangshan District People"s Government of Beijing Municipality as the Sponsors, together with Fangshan Sub-Bureau of the Beijing Municipal Commission of Planning and Natural Resources and the Liangxiang University Town Management Committee of Fangshan District in Beijing as the Organizers, are currently holding the "International Solicitation of Urban Design Proposals for Liangxiang University Town (Fangshan New Town Central District).” Design entities worldwide with related planning and design experience are publicly invited to participate and submit the Application Documents for Prequalification (hereinafter referred to as “Application Documents”). The Sponsors will select four final applicants as Participants for solicitation of proposals and for them to further submit their design proposals for response.

1.1 项目名称：良乡大学城（房山新城中心区）城市设计国际方案征集
1.1 Project name: International Solicitation of Urban Design Proposals for Liangxiang University Town (Fangshan New Town Central District)
1.2 项目位置：房山新城中心区是房山新城良乡组团的核心区域，距离北京中心城区约30公里，涵盖良乡大学城主园区、拓展区、良乡站和南关站轨道站点四个重点地区及辐射区域。
1.2 Project location: The Fangshan New Town Central District serves as the central hub of the Liangxiang cluster within Fangshan New Town. Situated around 30 kilometers from the heart of Beijing, this district comprises four pivotal zones: the Main Campuses of Liangxiang University Town, the Expansion Area, Liangxiang Station, and Nanguan Station (both of which are railway stations), along with their respective adjacent regions.
1.3 设计范围：分为总体城市设计研究范围和详细城市设计范围。
1.3 Design scope: The design scope is categorized into two components -- the overall urban design scope and the detailed urban design scope.
1.3.1 总体城市设计研究范围：位于良乡组团核心区域，即房山新城中心区，总用地面积约27.86平方公里；
1.3.1 The overall urban design scope: Situated in the heartland of the Liangxiang cluster, specifically known as the Fangshan New Town Central District, encompassing a total land area of around 27.86 square kilometers.
1.3.2 详细城市设计范围：包括特定重点区域未实施用地和重要廊道两个区域。四个特定重点区域设计范围约6.91平方公里（重点对未实施用地进行设计），包括良乡大学城主园区、良乡大学城拓展东区，良乡站轨道站点一体化区域及南关站轨道站点一体化区域。重要廊道设计范围约8.47平方公里。
1.3.2 The detailed urban design scope: This comprises two distinct areas, namely the designated key areas yet to be developed and the critical corridors. The design scope of the four designated key areas covers an approximate area of 6.91 square kilometers (with a specific focus on undeveloped land). These areas comprise the Main Campuses of Liangxiang University Town, the Liangxiang University Town East Expansion Area, the Liangxiang Station Integrated Rail Station Area, and the Nanguan Station Integrated Rail Station Area. The design scope of the critical corridors covers approximately 8.47 square kilometers.

4.应征申请人的资格
4. Eligibility and Qualifications of Applicants
4.1应征申请人（以下简称“申请人”）应为合法注册的法人实体或由合法注册的法人实体组成的项目联合体。
4.1 Any prequalification Applicant (hereinafter referred to as "Applicant") shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws.
4.2申请人应具有承担本征集项目规划设计的专业技术能力。
4.2 Applicants shall have the professional and technical ability to undertake the planning design of this solicitation project.
4.2.1 中华人民共和国境内的申请人应具有城乡规划编制甲级或工程设计建筑行业（建筑工程）甲级及以上资质；
4.2.1 Applicants within the People"s Republic of China should have a qualification certificate of Grade A for urban and rural planning or a qualification certificate of Grade A for architectural design (architectural engineering) or above;
4.2.2中华人民共和国境外的申请人须依本国或本地区的管理规定具有城市规划或建筑设计的执业许可或经营许可。
4.2.2 The Applicants outside the People"s Republic of China should have a practice license or business license for urban planning or architectural design in accordance with the national or local administrative regulations.
4.3 中华人民共和国境外的应征申请人须与境内的申请人组成联合体应征。
4.3 Any applicant outside the People"s Republic of China shall form a Consortium with an applicant inside the People"s Republic of China before participating.
4.4 香港、澳门特别行政区和台湾地区的规划设计机构的资格要求参照境外设计机构资格要求的规定。
4.4 The qualifications for planning and design entities from Hong Kong and Macau Special Administrative Regions as well as Taiwan shall refer to the requirements of qualifications for design entities outside the People’s Republic of China.
4.5应征申请人应有与本项目的功能性质相类似的规划设计经验；
4.5 Applicants should have experience in planning design similar to the functional nature of this Project;
4.6本项目接受联合体应征。
4.6 This Project accepts applications from Consortia.
4.6.1 联合体的各成员应共同签署一份联合体协议。
4.6.1 Partners of a Consortium shall jointly sign a consortium agreement.
4.6.2 组成项目联合体的各成员单位不得再以自己的名义单独申请资格预审，也不得同时加入本项目其它联合体申请资格预审。
4.6.2 Any partner of the Consortium shall neither individually apply for the prequalification in its own capacity, nor concurrently apply for the prequalification as a partner of another Consortium.
4.7 除联合体内部的成员外，参加征集的应征人之间不应存在关联关系。
4.7 Except for partners of a Consortium, the Participants in the solicitation shall not constitute or bear any affiliations.

The Prequalification Documents for this Project can be downloaded from the website of Beijing Science Park Auction & Tender Co., Ltd.
有意向参加应征的申请人需先在北京科技园拍卖招标有限公司网站（www.bkpmzb.com）下载资格预审文件领取登记表，填写完成后以Word版本E-mail至征集指定邮箱kjysanbu@163.com或递交至征集组织机构，征集组织机构收到登记表后，再将资格预审文件的下载密码发送给申请人。
Applicants who intend to participate in the solicitation for design proposals must first download the registration form from the website of Beijing Science Park Auction & Tender Co., Ltd. (www.bkpmzb.com). After completing the registration form, Applicants should email the Word version to kjysanbu@163.com or submit it to the Organizer of Solicitation. After receiving the registration form, the Organizer of Solicitation will send the download password of the Prequalification Documents to the Applicants.
获取资格预审文件的时间为2023年9月6日至2023年9月15日17:00（中国北京时间，下同）。北京科技园拍卖招标有限公司网站将于2022年9月6日开通。
The date for obtaining Prequalification Documents is from September 6, 2023 to 17:00 on September 15, 2023 (Beijing Time, the same below). The website of Beijing Science Park Auction & Tender Co., Ltd. will be accessible on September 6, 2022.
6.申请文件的递交
6. Submission of Application Documents
申请文件递交的截止时间为2023年9月21日下午17 时00分，申请人应在递交截止时间之前将申请文件递交至征集组织机构。主办单位、承办单位和征集组织机构将拒绝接收逾期送达的申请文件。
The deadline for submission of Application Documents is 5:00 p.m. on September 21, 2023. Applicants shall submit such documents to the Organizer of Solicitation before the deadline. The Sponsors, the Organizers, and the Organizer of Solicitation will reject any application documents that arrive after the specified deadline.

7. Media Releasing Announcement on Prequalification
本公告在中国招标投标公共服务平台（www.cebpubservice.com）、中国政府采购网（www.ccgp.gov.cn）、北京市房山区人民政府网站（www.bjfsh.gov.cn）、北京市规划和自然资源委的网站（ghzrzyw.beijing.gov.cn）和北京科技园拍卖招标有限公司网站（www.bkpmzb.com）同时发布。本公告的修改、补充以在以上网站发布的内容为准。
This announcement will be published on the China Tendering and Bidding Public Service Platform (www.cebpubservice.com), China Government Procurement Network (www.ccgp.gov.cn), the website of Fangshan District People"s Government of Beijing Municipality (www.bjfsh.gov.cn), the website of Beijing Municipal Commission of Planning and Natural Resources (ghzrzyw.beijing.gov.cn) and the website of Beijing Science Park Auction & Tender Co., Ltd. 8.1知识产权
8.1 Intellectual Property Rights (IPRs)
8.1.1 本次方案征集中接收的所有有效的应征文件（包括A3版面设计文册、A0标准轻质展板、模型、电子文件、应征设计方案著作权声明等）均不退回。
8.1.1 All valid response proposals received in this solicitation (including the A3 sized design book, A0 standard lightweight exhibition panels, models, electronic documents, and the Copyright Statement of Design Proposals) will not be returned.
8.1.2 应征设计文件和设计成果的知识产权由主办单位/承办单位与应征人共同享有。
8.1.2 The intellectual property rights (IPRs) of the Design Proposals and design results shall be commonly owned by the Sponsors/Organizers and the Participants.
8.1.2.1 应征人对其应征设计文件享有署名权，在征得主办单位/承办单位书面同意后可通过传播媒介、专业杂志、书刊或其他形式评价、展示其应征设计文件的相关内容。除应征人的设计标准、设计导则和绘图元素以外，应征人不得将应征设计文件及设计成果用于其他的设计项目。
8.1.2.1 Participants hold the right of authorship for their Design Proposals and can comment on and display such Design Proposals in the forms of media communications, trade magazines, publications among others after granted with the Sponsors’/Organizers’ consent in writing. The Participants shall not use the Design Proposals and design results on other design projects, except the Participants’ design standards, design guidelines, and drawing elements.
8.1.2.2 主办单位/承办单位有权在本项目的规划设计中使用应征人提交的规划设计成果，主办单位/承办单位在项目的规划设计中或在规划设计方案调整综合时可以全部或部分使用应征规划设计成果的内容，也可以对其进行修改。主办单位/承办单位不得将应征设计文件及设计成果用于本项目以外的其他项目。
8.1.2.2 The Sponsors/Organizers have the right to use the planning and design results submitted by the Participants in the planning and design of this Project. The Sponsors/Organizers are allowed to use the Design Proposals in whole or in part in the planning and design of this Project or the adjustment and integration of the planning and design proposals, and have the right to modify them. The Sponsors/Organizers shall not use the Design Proposals and design results for a purpose other than this Project.
8.1.2.3主办单位/承办单位可以对所有应征设计文件及设计成果印刷、出版和展览，并可通过传播媒介、专业杂志、书刊或其他形式评价、展示、宣传应征设计文件及设计成果，但应注明设计机构的名称。
8.1.2.3 The Sponsors/Organizers can print, publish and exhibit all the Design Proposals and design results, or comment on, display and publicize the Design Proposals and design results via media communications, trade magazines, publications, or by other means. The precondition is indication of the names of design entities for such design.
8.1.2.4应征建筑设计方案（如果有）的著作权归属于应征人，但景观小品及其建构筑物除外。
8. 1.2.4 The copyright of architectural design proposals (if any) shall belong to the Participants, except for landscape embellishments and their structures.
8.1.3应征人应保证提交的应征设计文件及设计成果在中华人民共和国境内或境外没有且不会侵犯任何其他人的知识产权（包括但不限于著作权、专利权）或专有技术或商业秘密。应征人应保证，如果其应征设计文件使用或包含任何其他人的知识产权或专有技术或商业秘密，应征人应已经获得权利人的合法、有效、充分的授权。应征人因侵犯他人知识产权或专有技术或商业秘密所引起的全部赔偿责任应由应征人承担。
8.1.3 Participants shall ensure that all the submitted Design Proposals and design results have not infringed upon and will not infringe upon IPRs (including but not limited to copyright and patent right) or proprietary technologies or trade secrets of others within or outside the People’s Republic of China. The Participants shall guarantee that if their Design Proposals use or include IPRs or proprietary technologies or trade secrets of others, the Participants shall have already obtained legitimate, valid and sufficient authorization from the right holders. Participants shall take all liabilities for any compensations arising from infringement upon IPRs or proprietary technologies or trade secrets of others.
8.2应征设计补偿金
8.2 Compensations for Designs Proposals
承办单位将向按征集文件的要求在规定的时间内提交了有效应征文件的应征人支付应征设计补偿金（以下简称“补偿金”），金额为人民币212.62万元（含税）。当应征人出现下列情况时，承办单位将不予支付补偿金：
The Organizers will pay Compensations for Design Proposals (hereinafter referred to as the “Compensations”) in the amount of RMB 2.1262 million (including tax) to any Participant who has submitted valid response documents within specified timeframe as required in the Solicitation Documents. The Organizers will not pay any compensation when Participants are under any of the following circumstances:
（1）应征人未能在征集文件规定的时间内提交应征文件；
(1) Participants fail to submit their response documents within the specified time as stated in the Solicitation Documents;
（2）应征人提交的应征文件被应征设计方案评审委员会认定为未对征集文件要求作出实质性响应；
(2) The response documents submitted by Participants are judged, by the Jury for Design Proposals, as not substantially responding to the requirements of the Solicitation Documents;
（3）应征人被取消应征资格。
(3) Participants are disqualified.
8.3奖项的设置
8.3 Awards settings
本次方案征集将评选出2个优胜设计方案，其应征设计方案被选为优胜方案的2个应征人须根据主办单位/承办单位的优化设计要求对其提交的设计方案进行优化，优化费用为人民币60万元（含税）。
There will be two winning Design Proposals in this solicitation. The two Participants whose Design Proposals are selected as the winning proposals must optimize their respective Design Proposals according to the requirements of the Sponsors/Organizers. The optimization fee is RMB 600,000 (including tax).
8.4征集后续工作
8.4 Follow-up work for the solicitation
本项目不依据方案征集的结果授予设计或咨询合同，其项目的方案综合、编制城市设计和城市设计导则以及配合主办单位/承办单位完成相关报审等工作将按照国家相关的法律法规另外选择设计单位。
This Project will not grant design or consulting contracts solely based on the outcomes of the proposal solicitation. The proposal integration, urban design preparation, formulation of urban design guidelines, and other associated review tasks in collaboration with the Sponsors/Organizers will be entrusted to a separate design entity in compliance with pertinent national laws and regulations.
8.5适用法律
8.5 Governing laws
本次征集活动本身及与本次活动相关的文件所适用的法律和法规仅为中华人民共和国的法律和法规。
The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
8.6语言
8.6 Languages
资格预审文件以及与资格预审文件相关的补充文件和澄清文件均使用中文和英文书写。申请文件应使用中文书写，申请人随申请文件提供的证明文件和印刷品可以使用另一种语言，但应附中文译本。在中文与其他语言的意思表达不一致时，以中文为准。
The language used in the Prequalification Documents and any supplement and clarification documents thereto shall be Chinese and English. Application Documents for Prequalification shall be drafted in Chinese. Another language can be used for the proof documents and printed materials that Applicants provide along with the Application Documents, but the version with Chinese translation shall be attached thereto. In the case of inconsistent expressions in both Chinese and another language, the Chinese version shall prevail.

8.7 Power of interpretation
本次征集活动的最终解释权归主办单位和承办单位。
The Sponsors and the Organizers reserve the power of final interpretation in view of the solicitation.
